{"id":153215,"date":"2021-12-14T19:03:43","date_gmt":"2021-12-14T13:33:43","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=153215"},"modified":"2021-12-14T19:03:43","modified_gmt":"2021-12-14T13:33:43","slug":"sc-notice-to-centre-on-social-security-cover-for-gig-workers","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/sc-notice-to-centre-on-social-security-cover-for-gig-workers\/","title":{"rendered":"SC notice to Centre on social security cover for gig workers"},"content":{"rendered":"\n<h5><b>What is the news?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court has agreed to examine the <\/span><span style=\"font-weight: 400;\">public interest litigation<\/span><span style=\"font-weight: 400;\"> seeking social security benefits to \u201cgig workers\u201d and \u201cplatform workers\u201d engaged by Uber, Ola Cabs, Swiggy and Zomato.<\/span><\/p>\n<h5><b>What is the case about?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">A petition was filed in the Supreme Court arguing that \u201cgig workers\u201d and \u201cplatform workers\u201d <strong>should be recognized as <\/strong><\/span><span style=\"font-weight: 400;\"><strong>\u201cunorganized workers\u201d<\/strong> and not \u201cindependent contractors\u201d as claimed by the companies.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">They should also be <strong>entitled to social security benefits<\/strong> such as insurance, provident fund, gratuity, maternity benefits and other welfare schemes that are denied to them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The petition referred to the <strong>recent United Kingdom Supreme Court judgment<\/strong> that has analysed the contract between Uber and the employee. It found that the contract is only a subterfuge <em>(a clever method used to evade rule or hide something)<\/em> and the real relationship between Uber and its employee is that of employer and employee.<\/span><\/p>\n<h5><b>What did the court say?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court pointed out that the new legislation Social Security Code 2020 passed by the Parliament in 2020 has a chapter dedicated for the welfare of &#8216;gig workers\u2019.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The petitioner argued that the Social Security Code 2020 is yet to be implemented.
