The Ministry of Home Affairs has informed Parliament <\/span>that there is no legal definition for the term \u201canti-national\u201d.<\/span><\/p>\n The word \u2018anti-national\u2019 has not been defined in statutes.<\/span><\/p>\n But it is relevant to mention that the Constitution (Forty\u2013Second Amendment) Act, 1976 inserted in the Constitution Article 31D (during Emergency) which defined \u2018anti-national activity\u2019.<\/span><\/p>\n However, Article 31D<\/strong> was subsequently omitted by the Constitution (Forty-third Amendment) Act, 1977.<\/span><\/p>\n \u200b\u200b\u2018Public Order\u2019 and \u2018Police\u2019 are State subjects as per the Seventh Schedule of the Constitution.<\/span><\/p>\n Hence, the data about the number of people arrested for indulging in anti-national activities are not maintained centrally. The responsibility of maintaining law and order, including registration and prosecution of crimes, protection of life and property, rested with the State government.<\/span><\/p>\n In 2019,\u00a0 National Crime Records Bureau<\/a> has released the annual \u2018Crime in India\u2019 report for 2017<\/a>.<\/span><\/p>\n It included for the first time a chapter on \u2018Crime Committed by Anti National Elements\u2019.
