News: <\/span><\/b>A Supreme court bench has sent proposal for the establishment of a National Judicial Infrastructure Corporation (NJIC)\u00a0<\/span>to the law ministry.<\/span>\u00a0<\/span><\/p>\n

There are serious issues of constitutional propriety <\/span>(correctness)<\/span><\/i> with how the apex court is gradually taking over the administration of the district judiciary<\/span>\u00a0<\/span><\/p>\n

What are the issues with the Supreme Court\u2019s approach?<\/span><\/b>\u00a0<\/span><\/h5>\n

Supreme court entering into states and high court\u2019s domain: <\/span><\/b>While the Supreme Court is the apex judicial institution, the C<\/span>onstitution clearly vests the administration of district judiciary (appointments, budgeting, daily running) <\/span>with the High Courts and state<\/span><\/b> governments<\/span>.<\/span>\u00a0<\/span><\/p>\n

–<\/strong> In the past also, the SC in various cases, has entered into domain of state government and high courts. For instance<\/strong>: Various SC judgements involving <\/span>All India Judges Association\u00a0<\/b>(AIJA)<\/b><\/em> where Supreme Court has been in a tussle with the government.<\/span>\u00a0<\/span><\/p>\n

–<\/strong> In another case, <\/span>Malik Mazhar Sultan v. UP Public Service Commission<\/b><\/em>, the supreme court expanded the initial litigation question regarding UP Judicial Service Rules, 2001 to include the status of judicial infrastructure in the state. <\/span>\u00a0<\/span><\/p>\n

SC in various cases has appointed an <\/span>amicus curiae<\/span><\/b> to advise it on the nature of judicial reforms to be implemented. They are generally selected from amongst the senior lawyers of the Supreme Court only.<\/span> The problem is that <\/span>neither they have any experience<\/span><\/b> of practising before the district judiciary <\/span>nor the skill and time required for policy research<\/span><\/b>.<\/span>\u00a0<\/span><\/p>\n

Also, as they are appointed by court they are <\/span>highly unlikely to point fingers at the judiciary<\/span><\/b>.<\/span>\u00a0<\/span><\/p>\n\n\n\n
Note – <\/em>An amicus curiae often referred to as amicus brief is defined as the legal brief where someone who is not a party to a case assists a court by offering information, expertise, or insight that has a bearing on the issues in the case.<\/span><\/i>\u00a0<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n

Courtroom policymaking by the Supreme Court <\/span>lacks public participation<\/span><\/b>.<\/span> Policymaking in a democratic polity should be done by political representative elected by the citizens.<\/span>\u00a0<\/span><\/p>\n

It <\/span>compromises principle of federalism<\/span><\/b> (which the court has held to be part of the \u201cbasic structure\u201d) \u00a0<\/em><\/p>\n

This \u201cone size fits all\u201d solutions does not accommodate the differences between states.<\/span>\u00a0<\/span><\/p>\n
