Petitions across courts have been seeking enforcement of this right, but it is <strong>not yet backed by statute<\/strong> in India.<\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>Must Read<\/strong>: <strong><a href=\"https:\/\/forumias.com\/blog\/right-to-be-forgotten\/\"><span style=\"color: #0000ff;\">Right to be Forgotten &#8211; Explained, pointwise<\/span><\/a><\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h5><strong>Do other countries have such laws?<\/strong><\/h5>\n<p>The <strong>European Union<\/strong> in 2018 adopted the <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/forumias.com\/blog\/gdpr\/\"><strong>General Data Protection Regulation<\/strong><\/a><\/span> (GDPR), <span style=\"color: #0000ff;\"><strong><a style=\"color: #0000ff;\" href=\"https:\/\/forumias.com\/blog\/right-to-be-forgotten\/\">Article 17<\/a><\/strong><\/span> of which provides for the right to erasure of certain categories of personal data.<\/p>\n<p><strong>Russia<\/strong> in 2015 enacted a law that allows users to force a search engine to remove links to personal information on grounds of irrelevancy, inaccuracy and violation of law.<\/p>\n<p>The right to be forgotten is also recognised to some extent in <strong>Turkey and Siberia<\/strong>, while courts in<strong> Spain<\/strong> and <strong>England<\/strong> have ruled on the subject.<\/p>\n<h5>What is the position in India?<\/h5>\n<p>In a brief reply to one of the petitions recently, the Centre told the Delhi High Court that the right to privacy has been recognised as a fundamental right in the K S Puttaswamy judgment (2017) and that the <strong>\u2018right to be forgotten\u2019 is evolving in India. <\/strong><\/p>\n<p>The government said the Personal Data Protection Bill <em>(a Joint Parliamentary Committee\u2019s report on which was tabled on December 16)<\/em>, contains provisions to the doctrine of the \u2018right to be forgotten\u2019.<\/p>\n<h5>What is the opinion of the courts on this issue?<\/h5>\n<p>In May 2019, Justice Pratibha M Singh of the Delhi High Court, dealing with a case said that: <em>The <strong>right to be forgotten<\/strong> and <strong>right to be left alone <\/strong>are inherent aspects of the right to privacy, and restrained republication of these news reports.<\/em><\/p>\n<p>In April 2021, the Delhi High Court directed <strong>removal of a judgment from search results<\/strong>; the order is now being opposed by Google.<\/p>\n<p>In January 2017, the <strong>Karnataka High Court<\/strong> ordered its registry to ensure that any Internet search engine does not reflect a woman\u2019s name in an order passed in 2015.<\/p>\n<p>In November 2020, the <strong>Orissa High Court<\/strong>, ruling in a case relating to videos uploaded on Facebook by a rape accused, stated that: <em>Allowing such objectionable photos and videos to remain on a social media platform, without the consent of a woman, is a direct affront (offence) on a woman\u2019s modesty and, more importantly, her right to privacy.
