{"id":156586,"date":"2021-12-28T20:19:05","date_gmt":"2021-12-28T14:49:05","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=156586"},"modified":"2021-12-28T20:19:05","modified_gmt":"2021-12-28T14:49:05","slug":"sc-clarifies-when-dowry-deaths-may-be-presumed","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/sc-clarifies-when-dowry-deaths-may-be-presumed\/","title":{"rendered":"SC clarifies when dowry deaths may be presumed"},"content":{"rendered":"\n<h5><b>What is the news?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">In a recent judgement, the Supreme Court of India has interpreted <\/span><span style=\"font-weight: 400;\">Section 304B of the Indian Penal Code (dowry death).<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><b>Must read:<\/b> <a href=\"https:\/\/forumias.com\/blog\/supreme-court-guidelines-on-section-304-b-of-ipc\/\"><b><span style=\"color: #0000ff;\">Supreme Court Guidelines on Section 304-B<\/span><\/b><\/a><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h5><b>How has the Supreme Court interpreted Section 304-B?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court has laid down the following prerequisites to be followed for convicting the accused for offence punishable under section 304B IPC:<\/span><\/p>\n<p><b>\u2013 <\/b><span style=\"font-weight: 400;\">that the death of a woman must have been caused by <strong>burns or bodily injury<\/strong> or occurred otherwise than under normal circumstance;<\/span><\/p>\n<p><b>\u2013 <\/b><span style=\"font-weight: 400;\">that such a death must have occurred <strong>within a period of seven years<\/strong> of her marriage;<\/span><\/p>\n<p><b>\u2013 <\/b><span style=\"font-weight: 400;\">that the woman must have been subjected to <strong>cruelty or harassment<\/strong> at the hands of her husband, soon before her death <em>(The expression<\/em><\/span><em><span style=\"font-weight: 400;\">\u201csoon before her death\u201d implies that the interval should not be much between the cruelty or harassment concerned and the death in question.
