China\u2019s new law on land borders<\/strong>, passed on October 23, has come into effect from 1st Jan 2022.<\/p>\n

This has happened at a time when,<\/p>\n

–<\/strong> The border standoff in eastern Ladakh remains unresolved<\/p>\n

–<\/strong> China has renamed several places in Arunachal Pradesh as part of its claim on the Indian state, and<\/p>\n

–<\/strong> The Chinese Embassy in Delhi has written to Indian MPs, including a minister, who had attended a dinner reception hosted by the Tibetan Parliament-in-exile.<\/p>\n\n\n\n

What is the new law?<\/h5>\n

The Standing Committee of China\u2019s National People\u2019s Congress passed the law for the protection and exploitation<\/strong> of the country\u2019s land border areas.<\/p>\n

It is encouraging the development of villages for civilians in the border areas <\/strong>by mandating\u00a0the state to take measures to<\/p>\n

–<\/strong> strengthen border defence<\/p>\n

–<\/strong> support economic and social development<\/p>\n

–<\/strong> improve public services and infrastructure in such areas<\/p>\n

–<\/strong> encourage and support people\u2019s life and work there<\/p>\n

It asks the state to resolve land border related-affairs with neighbouring countries through negotiations<\/strong>.<\/p>\n

The law lays conditions under which the state can impose emergency measures<\/strong>, including border shutdown.<\/p>\n

Why this law has been brought?<\/h5>\n

–<\/strong> It reflects Beijing\u2019s renewed concerns<\/strong> over the security of its land border while it confronts a range of unsettled disputes on its maritime front.<\/p>\n

–<\/strong> The Covid-19 pandemic has also highlighted the need for Beijing to exert greater control over its somewhat porous land border.<\/p>\n

What are its implications for India?<\/h5>\n

Although the law is not meant specifically for India, it is bound to have some impact.<\/p>\n\n\n\n
China and India share a disputed 3,488-km boundary, the third longest among China\u2019s 22,457-km land boundaries with 14 countries. Besides India, Bhutan (477 km) is the only other country with which China has a disputed land border.<\/em><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n

India-China relations<\/strong>: Beijing appears to be signaling determination to resolve the border disputes on its preferred terms.<\/p>\n

Some experts feel the new law will make China stick to its position<\/strong>, in the ongoing standoff as well as in the resolution of the larger boundary issue. Others feel the new law is only a tool China government will use<\/strong> if it wants, as its actions have been aggressive even before this law.<\/p>\n

As per Gautam Bambawale<\/strong>, who was India\u2019s ambassador to China in 2017-18 \u201cthe Chinese are clearly indicating that they are tired of trying to resolve the boundary or the LAC through negotiations; they\u2019re indicating they\u2019ll do it through use of force.<\/em><\/p>\n

As per Retired Army Major General Ashok Kumar<\/strong> the new law is the \u201clatest attempt by China to unilaterally delineate and demarcate territorial boundaries with India and Bhutan\u201d.\u00a0\u00a0<\/em><\/p>\n

India requires a <\/span>comprehensive solution<\/span><\/b> to tackle implications of this law and not just an approach focused on militarised solution alone.<\/span>\u00a0<\/span><\/p>\n
