News: <\/span><\/b>Election Commission<\/span><\/b> has <\/span>raised the expenditure limit<\/span><\/b> of candidates <\/span>to Rs 95 lakh<\/span><\/b> (up from Rs 70 lakh) each for Lok Sabha elections, and up to Rs 40 lakh (up from Rs 28 lakh) for Assembly polls.<\/span>\u00a0<\/span><\/p>\n

Similarly, for smaller states the new limit is Rs 28 lakh, up from Rs 20 lakh.<\/span>\u00a0<\/span><\/p>\n

What is meant by election expenditure limit?<\/span><\/b>\u00a0<\/span><\/h5>\n

Expenditure limit refers to the amount a candidate is allowed to <\/span>legally spend on election campaigning, including<\/span><\/b> public meetings, rallies, advertisements, posters and banners, and vehicles. <\/span>\u00a0<\/span><\/p>\n

All candidates<\/span><\/b> are required to submit their expenditure statement <\/span>to the EC<\/span><\/b> within 30 days of completion of an election.<\/span><\/b>\u00a0<\/span><\/p>\n

There <\/span>is no limit on how much a political party can spend<\/span><\/b> on elections, but they have to submit a statement of their expenditure to the EC within 90 days of completion of the elections.<\/span> \u00a0<\/span><\/p>\n

The money spent on star campaigners is credited to the party\u2019s account rather than the candidate.<\/span>\u00a0<\/span><\/p>\n

What are the reasons for the revision of the election expense?<\/span><\/b>\u00a0<\/span><\/h5>\n

Rise in number of electors:<\/span><\/b> Number of total voters in the country has increased from 834 million in 2014 to 936 million now. <\/span>\u00a0<\/span><\/p>\n

This means that each candidate is covering a much larger group of electors<\/span>. <\/span>\u00a0<\/span><\/p>\n

Cost Inflation Index (CFI)\u2013<\/span><\/b> has gone up from \u2018240\u2019 in FY 2014-15 to \u2018317\u2019 in current FY.<\/span>\u00a0<\/span><\/p>\n

It is used to estimate the increase in prices of goods and assets and fall in purchasing power of money year-on-year due to inflation.<\/span>\u00a0<\/span><\/p>\n

EC had also set up a <\/span>committee in 2020,<\/span><\/b> comprising retired IRS officer Harish Kumar,<\/strong> and other senior officers of the election commission to consider the change in the expense limits.<\/span>\u00a0<\/span><\/p>\n

Demand by Political Parties<\/span><\/b>-Political parties have time and again argued that the limit on the legal expenditure of candidates is not realistic.<\/span>\u00a0<\/span><\/p>\n

They also wanted the election expense to be revised to cover the added expense parties had to bear due to <\/span>digital campaigning<\/span><\/b> on account of Covid.<\/span> \u00a0<\/span><\/p>\n

What are the legal provisions regarding election expenditure?<\/span><\/b>\u00a0<\/span><\/h5>\n

Section 77<\/strong> of the <\/span>Representation of the People Act (RPA), 1951<\/span><\/b> mentions that every candidate must keep an account of all expenditure incurred from the date on which they are nominated to the date of declaration of the result.<\/span>\u00a0<\/span><\/p>\n

Section 10A<\/strong> of the Act also states that an incorrect account or expenditure beyond the cap can lead to disqualification of a candidate for up to three years.<\/span>\u00a0<\/span><\/p>\n

Have there been any studies about election expenses in India?<\/span><\/b>\u00a0<\/span><\/h5>\n

Association for Democratic Reforms (ADR) in<\/span><\/b> 2021 did a study analysing election expenditure statements of 538 of 543 MPs elected in 2019. <\/span>\u00a0<\/span><\/p>\n

This showed that they had on paper spent an average amount of Rs 50.84 lakh, or 73% of the expense limit.<\/span>\u00a0<\/span><\/p>\n
