While both India and the USA are culturally pluralistic societies which have a democratic form of government and similar judicial\u00a0systems,\u00a0they have different interpretation of the notion of Right to Equality.<\/span>\u00a0<\/span><\/p>\n\n\n\n\n

  1. United States had derived this right from Declaration of Rights and most importantly, from the Bill of Rights. It was inserted in the Bill of Rights through fourteenth Amendment in year 1868.<\/span>\u00a0<\/span><\/li>\n
  2. Concept of \u2018Equal protection of law\u2019 – equal treatment under equal\u00a0circumstances.\u00a0<\/span>\u00a0<\/span><\/li>\n<\/ol>\n

    1. Emphasis on civil and legal equality<\/span>\u00a0<\/span><\/li>\n
    2. Equality in procedural sense; focus on equality of opportunity.\u00a0<\/span>\u00a0<\/span><\/li>\n
    3. Original constitution did not prevent discrimination.\u00a0E.g.,\u00a0Segregation against African-Americans\u00a0before the Civil Rights Act, 1964.<\/span>\u00a0<\/span><\/li>\n<\/ol>\n<\/td>\n

  1. In India, the Constituent assembly had the intent to inculcate this right in the constitution at the initial level. Assembly did the same by inserting them in Chapter III named as \u201cFundamental Right\u201d.<\/span>\u00a0<\/span><\/li>\n
  2. Follows both \u2013 British model of \u2018Equality before Law\u2019 and American model of \u2018Equal\u00a0protection\u00a0of law\u2019 [Article 14]<\/span>\u00a0<\/span><\/li>\n
  3. Both civil-legal as well as socio-economic equality.<\/span>\u00a0<\/span><\/li>\n
  4. Substantive equality.\u00a0Provides expressly for Affirmative action to ensure equality\u00a0[Art 16]; Focus on ensuring Equality of outcomes along with equality of opportunity. [e.g., reservation in promotions]<\/span>\u00a0<\/span><\/li>\n
  5. Prevents discrimination and abolishes untouchability since its inception and adoption. [Art. 15, 17]<\/span>\u00a0<\/span><\/li>\n<\/ol>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n
