News<\/span><\/b>: <\/span>The Puttaswamy judgment and the Justice B.N. Srikrishna committee report led to the introduction of the Personal Data Protection Bill of 2019<\/span>.<\/span>\u00a0<\/span><\/p>\n

The bill was sent to a joint parliamentary committee for further scrutiny, which has now submitted its report. <\/span>\u00a0<\/span><\/p>\n

Although there are some concerns regarding the same.<\/span>\u00a0<\/span><\/p>\n

What are the concerns regarding the joint committee report on personal data protection bill?<\/span><\/b>\u00a0<\/span><\/h5>\n

Greater compliance burden on private sector: <\/span><\/b>Report has divided the digital world into two domains \u2014 government and private,<\/span> and puts a greater burden on private sector to comply with the privacy norms while almost exempting the state from the same.<\/span>\u00a0<\/span><\/p>\n

– Clause 35<\/span><\/b> exempts<\/span><\/b> government<\/span><\/b> agencies <\/span>from the entire Act<\/span><\/b> itself. <\/span>Clause 12<\/span><\/b> states that personal data can be processed without consent for the performance of any function of the state. The issue is that this is an umbrella clause <\/span>that does not specify which ministries or departments will be covered.<\/span><\/b>\u00a0<\/span><\/p>\n

–<\/strong> I<\/span>n one of the clause of the bill, it states that, \u201charm includes any observation or surveillance that is <\/span>not reasonably expected<\/span><\/b> by the data principal\u201d.<\/span> This means if that someone faced a data breach situation as a consequence of their own action of say suppose installing an app or a software then the privacy clause will not apply there. This clause can be used against the data principals.<\/span>\u00a0<\/span><\/p>\n

Data protection authority: <\/span><\/b>The act also talks about a Data protection authority (DPA). The <\/span>conditions of appointment <\/span><\/b>of the DPA also raise concerns<\/span>.<\/span>\u00a0<\/span><\/p>\n

Although the Justice Srikrishna committee report\u00a0provided for a judicial overlook in the appointments of the DPA, the \u00a0bill approved by the committee <\/span>rests the \u00a0power to appoint the panelists vests with the Central government.<\/span><\/b>\u00a0<\/span><\/p>\n

Clause 86<\/strong>\u00a0bounds the authority to follow the directions of the Central Government <\/span><\/b>under all cases, and not just on questions of policy.<\/span>\u00a0<\/span><\/p>\n

–<\/strong> Also, <\/span>appointment of the authority <\/span>violates the principle of federalism<\/span><\/b>. Because the issue involves internal data flow and the States are key stakeholders in the process<\/span>.<\/span>\u00a0<\/span>Apart from this \u2018<\/span>public order\u2019 is an entry in the State List<\/span><\/b> (which can be one of the reasons on which directions to allow processing of data can be issued), this makes involving states also important.<\/span>\u00a0<\/span><\/p>\n

Non-personal data: <\/span><\/b>The committee has included the non-personal data within the ambit of the Bill.<\/span>\u00a0<\/span><\/p>\n

This will put a <\/span>lot of burden on the MSME sector and small businesses,<\/span><\/b> as technical processes involving data-sharing are very expensive. <\/span>\u00a0<\/span><\/p>\n

Government-constituted <\/span>panel headed by S. Gopalkrishnan<\/span><\/b> also opposed the idea of including non-personal data in the Bill as Mandatory data localisation will according to some estimates <\/span>squeeze the economy by 0.7-1.7%.<\/span><\/b>\u00a0<\/span><\/b>\u00a0<\/span><\/p>\n
