Union of India<\/span><\/b><span data-contrast=\"none\"> it held that CIL which is not contrary to the municipal law shall be deemed to have been incorporated in India\u2019s domestic law.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">This principle has been affirmed in subsequent decisions like in <\/span><b><span data-contrast=\"none\">Research Foundation for Science v. Union of India.<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\"> Here<\/span><span data-contrast=\"none\">, the SC, relying on the Vellore Citizen case, <\/span>declared that the<b><span data-contrast=\"none\"> <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/forumias.com\/blog\/precautionary-principle\/\">precautionary principle<\/a><\/span>, <\/span><\/b>an environmental law concept, <strong>is part of CIL and thus part of Indian law. \u00a0<\/strong><\/p>\n<h5><b><span data-contrast=\"none\">What are the positives of this practice?<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h5>\n<p><span data-contrast=\"none\">Most countries have been incorporating CIL as part of the domestic legal regime, so the Supreme court\u2019s practice is <\/span><b><span data-contrast=\"none\">in line with international practice.<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">It provides judiciary with an opportunity for <\/span><b><span data-contrast=\"none\">making the law progressive,<\/span><\/b><span data-contrast=\"none\"> e<\/span><span data-contrast=\"none\">sp when the executive and the parliament for ideological or political persuasions fail to enact laws transforming a liberal international legal norm into domestic law.<\/span> <span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h5><b><span data-contrast=\"none\">What are the challenges that still remain?<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h5>\n<p><span data-contrast=\"none\">CIL is sometimes very easily accepted as part of Indian law. <\/span><span data-contrast=\"none\">For instance, the Supreme Court quite readily accepted the precautionary principle, but it is yet to get wide global acceptance.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">However, SC <\/span><b><span data-contrast=\"none\">hasn\u2019t been consistent<\/span><\/b><span data-contrast=\"none\"> in incorporating CIL.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\">\u00a0<\/span><span data-contrast=\"none\"><strong>Example<\/strong>: In the Mohamad Salimullah v. Union of India, the court refused to stop the deportation of Rohingya refugees to Myanmar despite the principle of <span style=\"color: #0000ff;\"><strong><a style=\"color: #0000ff;\" href=\"https:\/\/forumias.com\/blog\/non-refoulement-principle\/\">nonrefoulement<\/a><\/strong><\/span> being part of CIL. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">It <\/span><b><span data-contrast=\"none\">goes against the democratic practice<\/span><\/b><span data-contrast=\"none\"> and creates a <\/span><b><span data-contrast=\"none\">democratic deficit<\/span><\/b><span data-contrast=\"none\">.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">As judicial incorporation of international law is the violation of separation of power and judiciary overtaking Parliament\u2019s right.
