Supreme Court has raised concern over frequent suspension of MPs\/MLAs and also stated that if\u00a0this trend is a\u00a0\u201cdanger to democracy\u201d.\u00a0<\/span><\/p>\n

Why have been some recent instances of suspension of MP\/MLAs have come under criticism?<\/span><\/b>\u00a0<\/span><\/p>\n

12 Rajya Sabha members were suspended in the winter session-Since the\u00a0allegation of\u00a0misbehaviour\u00a0were from the time of monsoon session<\/span><\/b>,\u00a0the opposition complained that the action contravened House business rules.<\/span>\u00a0<\/span><\/p>\n

It said that rules allowed suspension only for the remainder of the session, not for the next session.<\/span>\u00a0<\/span><\/p>\n

Maharashtra assembly\u2019s suspension of 12 BJP MLAs<\/span><\/b>-SC \u00a0noted that since suspensions are aimed at ensuring smooth conduct of House business, extending them beyond the ongoing session would be \u201cirrational\u201d.<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

What is the way forward?\u00a0<\/span><\/b>\u00a0<\/span><\/p>\n

Presiding officers<\/span><\/b>\u00a0are responsible for ensuring government\u2019s legislative business is transacted smoothly with keen House participation. They should have a non-partisan conduct.<\/span>\u00a0<\/span><\/p>\n

According to SC suspensions must be\u00a0<\/span>kept short<\/span><\/b>\u00a0and preferably for only the ongoing session.<\/span>\u00a0<\/span><\/p>\n

If Legislative conduct turns unconstitutional or illegal it can also turn into a threat to\u00a0<\/span>separation of power.<\/span><\/b>\u00a0<\/span><\/p>\n
