It observed that <\/span><b>Merit cannot be reduced to narrow definitions of performance in an open competitive examination, <\/b><span style=\"font-weight: 400;\">which only provides formal equality of opportunity.<\/span><\/p>\n<p>Moreover,<strong> O<\/strong><b>pen competitive examinations do not reflect the social, economic and cultural advantage <\/b><span style=\"font-weight: 400;\">that accrues to certain classes and contributes to their success in such examinations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hence,<\/span><b> Merit should be socially contextualised and reconceptualized<\/b><span style=\"font-weight: 400;\"> as an instrument that advances social goods like equality that we as a society value. In such a context, <\/span><b>reservation is not at odds with merit but furthers its distributive consequences.<\/b><\/p>\n<h6><b>Supreme Court on Article 15<\/b><\/h6>\n<p><span style=\"font-weight: 400;\">The <\/span><span style=\"font-weight: 400;\">power of the government to provide reservations under <\/span><b>Article 15(4) and (5) of the Constitution is not an \u201cexception\u201d to Article 15(1) <\/b><span style=\"font-weight: 400;\">which enshrines the mandate that \u201cthe State shall not discriminate against any citizen on grounds only of religion, race, caste, sex, place of birth or any of them\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Moreover, the power of the government to craft reservations for the OBC amplified the principle of \u201c<\/span><b>substantive equality<\/b><span style=\"font-weight: 400;\">\u201d manifested through Article 15 (1).<\/span><\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><em><b>Note: <\/b><span style=\"font-weight: 400;\">Substantive equality is a fundamental aspect of human rights law that is concerned with equitable outcomes and equal opportunities for disadvantaged and marginalised people and groups in society.<\/span><\/em><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">This post is based on the article<\/span> <b>\u2018<\/b><b>Supreme Court upholds validity of OBC quota in NEET admissions<\/b><b>\u2019<\/b> <span style=\"font-weight: 400;\">published in <\/span><b>PIB <\/b><span style=\"font-weight: 400;\">on<\/span> <b>21st January 2022.<\/b><\/p>\n","protected":false},"excerpt":{"rendered":"<p>What is the News?
