India is a <\/span>constitutional democracy<\/span><\/b>, where the constitution provides for both rights and duties. However, the original constitution did not have provision for duties. It was added to the constitution by the 42nd constitution amendment act under Part IV A.<\/span>\u00a0<\/span><\/p>\n

Rights are understood as entitlements or claims<\/span><\/b> against the state, which are essential for the holistic development of the individuals. Whereas <\/span>Duties are moral obligations on individuals<\/span><\/b> for performance of certain actions in the welfare of society and state.\u00a0<\/span>\u00a0<\/span><\/p>\n

Rights and duties<\/span><\/b> may seem like two different concepts but they are <\/span>functionally related<\/span><\/b>. As <\/span>Mahatma Gandhi<\/span><\/b> in <\/span>Hind Swaraj<\/span><\/b> observed that \u201c<\/span>Real rights are a result of the performance of duty<\/span><\/b>\u201d. He held that <\/span>rights are present in duties in embryonic form<\/span><\/b>, when duties are performed it automatically gives rise to rights.<\/span>\u00a0<\/span><\/p>\n
