However there have been several recent instances where Center-State relationship has deteriorated especially the States ruled by opposition political parties.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<ul>\n<li data-leveltext=\"\u2022\" data-font=\"Helvetica\" data-listid=\"1\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><b><span data-contrast=\"none\">Legislative relations <\/span><\/b><b><span data-contrast=\"none\">&#8211;\u00a0<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li data-leveltext=\"\u2022\" data-font=\"Helvetica\" data-listid=\"1\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"2\"><b><span data-contrast=\"none\">Misuse of Article 356<\/span><\/b><span data-contrast=\"none\"> to dismiss the State Governments. The expression \u2018<\/span><b><span data-contrast=\"none\">combative federalism\u2019<\/span><\/b><span data-contrast=\"none\"> was used by a former CM whose government was dismissed under Art. 356 in 2016.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\u2022\" data-font=\"Helvetica\" data-listid=\"2\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"2\"><b><span data-contrast=\"none\">Partisan role of Governor in legislative affairs<\/span><\/b><span data-contrast=\"none\">: In <\/span><b><span data-contrast=\"none\">Rajasthan<\/span><\/b><span data-contrast=\"none\">, the Governor refused to summon a session as desired by the Council of Ministers. In <\/span><b><span data-contrast=\"none\">Goa, Karnataka and Maharashtra<\/span><\/b><span data-contrast=\"none\">, the Governor acting beyond his constitutional brief by invited parties and formations which did not have an adequate majority to form the governments.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\u2022\" data-font=\"Helvetica\" data-listid=\"3\" aria-setsize=\"-1\" data-aria-posinset=\"3\" data-aria-level=\"2\"><b><span data-contrast=\"none\">Encroachment of Centre on the subjects mentioned in the list: <\/span><\/b><span data-contrast=\"none\">Many experts view the recent farm acts passed by the Union government as encroachment on the state list.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li data-leveltext=\"\u2022\" data-font=\"Helvetica\" data-listid=\"4\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><b><span data-contrast=\"none\">Administrative relations<\/span><\/b><b><span data-contrast=\"none\">&#8211;<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span>\n<ul>\n<li><span data-contrast=\"none\">The proposed<\/span><b><span data-contrast=\"none\"> amendments to the Indian Administrative Service (IAS) (Cadre) Rules of 1954<\/span><\/b><span data-contrast=\"none\">, attempt to alter the terms of central deputation in favour of the Union Government and many states have opposed the changes.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<li><b><span data-contrast=\"none\">Deployment of central investigative agencies in the States<\/span><\/b><span data-contrast=\"none\">: States argue that the Deployment of central investigative agencies violate federal principles as law and order is a State subject e.g., the investigation of gold-smuggling case by the NIA has been opposed by Kerala. Various States have <\/span><b><span data-contrast=\"none\">withdrawn the general consent<\/span><\/b><span data-contrast=\"none\"> for the CBI in their respective jurisdictions.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li data-leveltext=\"\u2022\" data-font=\"Helvetica\" data-listid=\"4\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><b><span data-contrast=\"none\">Financial relations-<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li data-leveltext=\"\u2022\" data-font=\"Helvetica\" data-listid=\"4\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"2\"><b><span data-contrast=\"none\">Allocation of financial resources<\/span><\/b><span data-contrast=\"none\">:\u00a0 Although the share of states in central taxes has increased states have complained of discrimination in allocation of resources. <\/span><b><span data-contrast=\"none\">Use of 2011 census<\/span><\/b><span data-contrast=\"none\"> for population data by the<\/span><b><span data-contrast=\"none\"> 15th finance commission<\/span><\/b><span data-contrast=\"none\">, was criticized by southern states.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\u2022\" data-font=\"Helvetica\" data-listid=\"4\" aria-setsize=\"-1\" data-aria-posinset=\"3\" data-aria-level=\"2\"><b><span data-contrast=\"none\">GST Compensation cess<\/span><\/b><span data-contrast=\"none\">: The Inability of the Union Government to pay compensation cess, during the Covid-19 created an issue between center and states.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span data-contrast=\"none\">This present trend of <\/span><b><span data-contrast=\"none\">combative federalism is antithetical to the vision of constitution makers that wanted to create a cooperative and collaborative Indian polity.\u00a0<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The idea behind the concept of collaborative federalism is <\/span><b><span data-contrast=\"none\">negotiation and coordination<\/span><\/b><span data-contrast=\"none\"> so that differences which may arise between the Centre and the State Governments can be ironed out. The Union and State Governments need to rise above partisan politics and utilize forums like <\/span><b><span data-contrast=\"none\">Interstate council<\/span><\/b><span data-contrast=\"none\"> and <\/span><b><span data-contrast=\"none\">GST council<\/span><\/b><span data-contrast=\"none\"> to arrive at solutions.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Introduction: Give a background of federal relations in India.
