{"id":174751,"date":"2022-03-17T19:53:38","date_gmt":"2022-03-17T14:23:38","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=174751"},"modified":"2022-03-17T19:53:38","modified_gmt":"2022-03-17T14:23:38","slug":"explained-the-rank-pension-case","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/explained-the-rank-pension-case\/","title":{"rendered":"Explained: The rank-pension case"},"content":{"rendered":"\n<h5><b>What is the News?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court upheld the manner in which the government had introduced the &#8220;One Rank One Pension&#8221; scheme in defence forces.<\/span><\/p>\n<h5><b>What is One Rank One Pension(OROP)?<\/b><\/h5>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-174752 size-full\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2022\/03\/1646206596_OROP_Drishti_IAS_English.jpg?resize=519%2C503&#038;ssl=1\" alt=\"\" width=\"519\" height=\"503\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2022\/03\/1646206596_OROP_Drishti_IAS_English.jpg?w=519&amp;ssl=1 519w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2022\/03\/1646206596_OROP_Drishti_IAS_English.jpg?resize=300%2C291&amp;ssl=1 300w\" sizes=\"auto, (max-width: 519px) 100vw, 519px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">One Rank, One Pension rule means that retired soldiers of the same rank and length of service will receive the same pension, regardless of when they retire.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Roughly translated, a sepoy who retired in 1995 with 20 years of service should get the same pension as a sepoy who retired in 2010 after 20 years of service.\u00a0<\/span><\/p>\n<h5><b>Background of OROP<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">From 1950 to 1973, there was a concept known as the Standard Rate of Pension, which was similar to OROP.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 1974, when the 3rd Pay Commission came into force, certain changes were effected in terms of weightage, additional years of notion service, etc regarding pensions. In 1986, the 4th Pay Commission\u2019s report brought further changes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">What ultimately happened was that the benefits of the successive pay commissions were not passed to servicemen who had retired earlier. Pensions were deferred for those who had retired at the same rank, with the same years of service, but years apart.<\/span><\/p>\n<h5><b>Demand of OROP<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Ex-servicemen demanded OROP to correct the discrepancy. Over the decades, several committees looked into it.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <strong>Brig K P Singh Deo committee<\/strong> in 1983 recommended a system similar to the Standard Rate of Pension, as did Parliament\u2019s standing committees on defence.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2011, the Rajya Sabha Committee on Petitions (<strong>Koshyari Committee<\/strong>) recommended the implementation of OROP<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2015, the government notified the current OROP scheme and it was made applicable from July 1, 2014.<\/span><\/p>\n<h5><b>Challenge in Supreme Court against this OROP Scheme<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">A petition was filed in the Supreme Court challenging the current OROP Scheme implemented since 2015.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The petitioner argued that in the course of implementation, the OROP principle has been replaced by \u2018one rank multiple pensions\u2019 for persons with the same length of service.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is because the current OROP scheme says that equalization of pension would happen periodically every five years.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the equalization of pension should be automatic, that is, whenever there is disparity. The gap of five years would leave them at a great disadvantage.<\/span><\/p>\n<h5><b>What has the Supreme Court said?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court upheld the manner in which the government had introduced the &#8220;One Rank One Pension&#8221; scheme in defence forces.
