The European Union (EU) has finalized details of its Digital Markets Act(DMA).<\/span><\/p>\n The DMA defines <\/span>clear rules<\/span> for <\/span>large online platforms<\/span>. It aims to ensure that no large online platform that acts as a <\/span>\u2018gatekeeper\u2019<\/span> for a large number of users abuses its position to the detriment of companies wishing to access such users.<\/span><\/p>\n To qualify as a gatekeeper:<\/span><\/p>\n Firstly,<\/b> it must either have had an annual turnover of at least <\/span>\u20ac7.5 billion<\/b> within the European Union (EU) in the past three years or have a market valuation of at least <\/span>\u20ac75 billion<\/b><\/p>\n Secondly, <\/b>it must have at least <\/span>45 million monthly end-users<\/b> and at least <\/span>10,000 business users<\/b> established in the EU.<\/span><\/p>\n Thirdly, <\/b>the platform must also control <\/span>one or more core platform services<\/b> in at least <\/span>three member states<\/b>. These core platform services include marketplaces and app stores, search engines, social networking, cloud services, advertising services, voice assistants and web browsers.<\/span><\/p>\n Note:<\/b> Small and medium enterprises are exempt from being identified as gatekeepers.<\/span><\/p>\n According to the Act,\u00a0<\/span><\/p>\n Gatekeepers will have to:<\/b><\/p>\n \u2013 ensure that users have the right to unsubscribe from core platform services under similar conditions to subscription,<\/span><\/p>\n \u2013 U<\/span>sers will not be forced to use software by default when installing the OS and mentions web browsers,<\/span><\/p>\n \u2013 Interoperability between the basic functionalities of messaging services. This could mean that a user on WhatsApp and one on iMessage should be able to talk to each other,<\/span><\/p>\n \u2013 Allow app developers fair access to the supplementary functionalities of smartphones (e.g. NFC chip),<\/span><\/p>\n \u2013 give sellers access to their marketing or advertising performance data on the platform,<\/span><\/p>\n \u2013 inform the European Commission of their acquisitions and mergers.<\/span><\/p>\n But the Gatekeepers cannot: 1) <\/b>Rank their own products or services higher than those of others (self-preferencing), <\/span>2)<\/b> Reuse private data collected during a service for the purposes of another service, <\/span>3)<\/b> Establish unfair conditions for business users, <\/span>4) <\/b>Pre-install certain software applications require app developers to use certain services (e.g. payment systems or identity providers) in order to be listed in app stores.<\/span><\/p>\n If a gatekeeper violates the rules laid down in the legislation, it risks <\/span>a fine<\/b> of <\/span>up to 10%<\/b> of its total worldwide turnover.
