{"id":177326,"date":"2022-04-02T20:33:12","date_gmt":"2022-04-02T15:03:12","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=177326"},"modified":"2022-04-02T20:33:12","modified_gmt":"2022-04-02T15:03:12","slug":"quota-and-data-on-vanniyar-quota-verdict","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/quota-and-data-on-vanniyar-quota-verdict\/","title":{"rendered":"Quota and data: On Vanniyar quota verdict"},"content":{"rendered":"\n<p><strong>News: Recently, <\/strong>the Supreme Court of India\u00a0<strong>quashed the Tamil Nadu Special Reservation Act of 2021,<\/strong> or the Vanniyar quota law, on the ground that it was not based on updated quantifiable data.<\/p>\n<h5><strong>What was proposed in the legislation?<\/strong><\/h5>\n<p><strong>Read here<\/strong>: <a href=\"https:\/\/forumias.com\/blog\/supreme-court-strikes-down-tamil-nadus-10-5-vanniyar-quota\/\" target=\"_blank\" rel=\"noopener\">Supreme Court strikes down Tamil Nadu\u2019s 10.5% Vanniyar quota<\/a><\/p>\n<h5><strong>What were the issues in the proposed reservation?<\/strong><\/h5>\n<p>The Court said, caste can be the starting point for the identification of backward classes or providing internal reservation, but it cannot be the sole basis for giving reservation.<\/p>\n<p>The Court pointed out that the <strong>relative backwardness<\/strong> and <strong>representation of other communities<\/strong> in the MBCs and DNCs were not analysed using <strong>relevant, updated and contemporaneous data.<\/strong><\/p>\n<h5><strong>What is the importance of judgment with respect to the state\u2019s power on the reservation?<\/strong><\/h5>\n<p><strong>First<\/strong>, the court held that the State is competent to design <strong>subclassification<\/strong> among backward classes. It can prescribe the <strong>quantum of reservation <\/strong>based on such <strong>subclassification<\/strong>, and formulate an <strong>ancillary law<\/strong>, even with the assent of the Governor, to one included in the Ninth Schedule. But, Internal or exclusive reservations cannot be granted to any community without using <strong>quantifiable data<\/strong>.<\/p>\n<p><strong>Second<\/strong>, a <strong>caste-based census<\/strong> is required to determine the representation of various communities in public employment and in education. If there is an inadequate representation, it may be a ground for special treatment in the reservation.<\/p>\n<p><strong>Third<\/strong>, the concept of a creamy layer is very important to uphold the <strong>principle of equity<\/strong> in the reservation.
