The reason is that such impressions cannot be changed. However, the <\/span><b><span data-contrast=\"none\">compulsory extraction<\/span><\/b><span data-contrast=\"none\"> of an <\/span><b><span data-contrast=\"none\">oral<\/span><\/b><span data-contrast=\"none\"> or <\/span><b><span data-contrast=\"none\">written statement<\/span><\/b><span data-contrast=\"none\"> from the accused are prohibited in the Constitution.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">In 2005, the <\/span><b><span data-contrast=\"none\">Code of Criminal Procedure (CrPC<\/span><\/b><span data-contrast=\"none\">) was amended. It allowed a magistrate to order any person to give their <\/span><b><span data-contrast=\"none\">handwriting samples<\/span><\/b><span data-contrast=\"none\"> for the purpose of an investigation or proceeding.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">In 2019, the Supreme Court, in <\/span><em><b>Ritesh Sinha v. State of UP<\/b> <b>Case<\/b><\/em><span data-contrast=\"none\">, ruled that handwriting samples could include <\/span><b><span data-contrast=\"none\">voice samples<\/span><\/b><span data-contrast=\"none\">. This would <\/span><b><span data-contrast=\"none\">not violate<\/span><\/b><span data-contrast=\"none\"> the right against self-incrimination<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<h5><b><span data-contrast=\"none\">What are the issues in the proposed bill?<\/span><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:420}\">\u00a0<\/span><\/h5>\n<p><span data-contrast=\"none\">The <\/span><b><span data-contrast=\"none\">1962 judgment\u2019s logic<\/span><\/b><span data-contrast=\"none\"> used to interpret what would violate the right against self-incrimination is unlikely to apply to technologies in use today. The proposed bill authorizes the agencies to use <\/span><b><span data-contrast=\"none\">new<\/span><\/b><span data-contrast=\"none\"> and <\/span><b><span data-contrast=\"none\">emerging technologies<\/span><\/b><span data-contrast=\"none\"> for processing, sharing, and dissemination of data.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The Bill is <\/span><b><span data-contrast=\"none\">vaguely worded<\/span><\/b><span data-contrast=\"none\">. It may lead to new forms of coercion of accused persons. It may lead to new forms of surveillance and the stifling of dissent.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The new technologies would be used in <\/span><b><span data-contrast=\"none\">policing<\/span><\/b><span data-contrast=\"none\"> and <\/span><b><span data-contrast=\"none\">the criminal justice system<\/span><\/b><span data-contrast=\"none\">. They have new implications for the right against self-incrimination. They will be used to find patterns like <\/span><b><span data-contrast=\"none\">one\u2019s personal beliefs<\/span><\/b><span data-contrast=\"none\"> or <\/span><b><span data-contrast=\"none\">behaviour<\/span><\/b><span data-contrast=\"none\">.
