News: <\/span><\/b>Recently, the western countries have mulled to increase the height of their <\/span>economic sanctions <\/span><\/b>on Russia. This has been because a series of\u202f<\/span>suspected war crimes <\/span><\/b>in the Ukrainian town of Bucha has been discovered. <\/span><\/p>\n There are apprehensions that Russia may undertake new offensive measures in coming period. In this regard, the <\/span>sanction regime<\/span><\/b> has come into limelight.<\/span>\u00a0<\/span><\/p>\n A sanction can be defined as \u201c<\/span>a measure of coercion of an economic nature<\/span><\/b> as opposed to diplomatic or military coercion\u201d. Such measures may include <\/span>complete or partial embargoes<\/span><\/b> like trade, travel, financial transactions, freezing financial assets etc.<\/span>\u00a0<\/span><\/p>\n These measures can have a huge impact on <\/span>human rights<\/span><\/b> and <\/span>populations<\/span><\/b> of the target country. In addition, the sanctions also lead to serious <\/span>medium-term impact<\/span><\/b> on the very countries which issued because of the <\/span>globalised economy<\/span><\/b>.\u00a0<\/span>\u00a0<\/span><\/b><\/p>\n The sanction can be <\/span>individual sanction <\/span><\/b>(For example, the US sanctions) or <\/span>collective sanction<\/span><\/b> (For example, by the UN or the European Union).\u00a0<\/span>\u00a0<\/span><\/p>\n (A) The UNSC Collective sanctions <\/span><\/b>can be taken while adhering to a<\/span> strict procedure mentioned below<\/span><\/b>:\u00a0<\/span>\u00a0<\/span><\/p>\n (1) First the \u201c<\/span>existence of any threat to peace, breach of the peace, and an act of aggression<\/span><\/b>\u2019 needs to be determined\u201d (<\/span>Article 39)<\/span><\/b>.\u00a0<\/span>\u00a0<\/span><\/p>\n (2) Second, <\/span>complete<\/span><\/b> or <\/span>partial interruption of economic relations<\/span><\/b> can be undertaken under sanctions. They can be related to rail, sea, air, postal, telegraphic, radio, and other means of communication. It may include the severance of diplomatic relations. However, the \u201c<\/span>use of armed force<\/span><\/b>\u201d is not allowed under these measures (<\/span>Article 41<\/span><\/b>)<\/span>\u00a0<\/span><\/p>\n Since 1966, the UNSC has adopted <\/span>30 regimes of sanctions<\/span><\/b>. At present, 14 are operational. They are administered by a sanctions committee chaired by <\/span>a non-permanent member<\/span><\/b> of the UNSC. In addition, the EU has imposed 30 sanctions regimes so far.<\/span>\u00a0<\/span><\/p>\n (B) <\/span>The individual sanctions<\/span><\/b>: The International trade agreements such as GATT, GATS, and TRIPS along with a number of bilateral investment treaties allow economic sanctions for security reasons.<\/span>\u00a0<\/span><\/p>\n Hence, unilateral individual sanctions have no legal basis in a treaty. They goes out of the <\/span>jurisdiction<\/span><\/b> as they are clearly <\/span>extraterritorial<\/span><\/b> in nature.\u00a0<\/span>\u00a0<\/span><\/p>\n These unilateral sanctions are called <\/span>\u201ccountermeasures\u201d<\/span><\/b> in the language of <\/span>the International Law Commission.<\/span><\/b>\u00a0<\/span><\/p>\n The sanctions affect<\/span> private actors<\/span><\/b> and also lead to significant<\/span> economic harm <\/span><\/b>and <\/span>disruption<\/span><\/b> in supply chains.\u00a0<\/span>\u00a0<\/span><\/p>\n The individual sanctions are narrower in scope. They cannot be imposed in cases other than security concern. In WTO disputes <\/span>\u2018Russia \u2013 Measures Concerning Traffic in Transit\u2019 (DS 512)<\/span><\/b> and <\/span>\u2018Saudi Arabia \u2013 Protection of IPRs\u2019 (DS567),<\/span><\/b> it was declared that these measures are partially justiciable.<\/span>\u00a0<\/span><\/p>\n In fact, these sanctions have been declared ambiguous and illegal by the <\/span>international tribunal (here ICJ)<\/span><\/b>.
