News:<\/span><\/b> Recently, in two separate judgements, the <\/span>Supreme Court (SC) of India<\/span><\/b> has struck down the reservations that were awarded by the Maharashtra government and Tamil Nadu government. <\/span><\/p>\n Both judgments identified the same problem – a lack of<\/span> evidence-driven policymaking by the state govt <\/span><\/b>for reservations. Maharashtra Case: <\/span><\/b>A separate 27% reservation to Other Backward Classes (OBC) in local body elections was struck down. <\/span><\/p>\n –<\/strong> It was not based on <\/span>empirical data <\/span><\/b>and <\/span>research<\/span><\/b>. <\/span><\/p>\n –<\/strong> In addition, it failed to meet the mandatory <\/span>triple test<\/span><\/b> laid down by the court. There was inadequate<\/span>\u00a0<\/span><\/p>\n In Tamil Nadu Case: <\/span><\/b>The internal reservations of 10.5% for the<\/span> Vanniyar community<\/span><\/b> was struck down. There was absence of quantifiable data or basis for providing a quota specifically for a single OBC community.\u00a0<\/span>\u00a0<\/span><\/p>\n (1) There are state level differences across the parameters<\/span>\u00a0<\/span><\/p>\n – Eligible population:<\/span><\/b> (a)<\/strong> About 55% of Maharashtra\u2019s population is eligible for reservations. Out of total population, OBCs constitute about 33.8%, and (b)<\/strong> In Tamil Nadu, 97.2% of population is eligible and 76% of the population is classified as OBC.\u00a0<\/span>\u00a0<\/span><\/p>\n – <\/strong>Reserved seats:<\/span><\/b> In Maharashtra, the total number of seats reserved for OBC\/SC\/ST candidates is capped at 50% (<\/span>Indra Sawhney case)<\/span><\/b>. However, in Tamil Nadu, 69% of seats are reserved. In fact, half the seats in Tamil Nadu are reserved solely for OBC candidates.<\/span>\u00a0<\/span><\/p>\n (2) There is a lack of <\/span>reliable caste-level data<\/span><\/b>. It makes space for an imbalance between caste groups in access to opportunities. It hampers improvements of the affirmative programme.<\/span>\u00a0<\/span><\/p>\n (3) There is a prevalence of a huge imbalance in the distribution of the benefits. For example, as per the<\/span> Rohini Commission report<\/span><\/b>, over 1,000 OBC caste groups have not received any benefit whatsoever from <\/span>India\u2019s reservation programme<\/span><\/b>\u00a0<\/span><\/p>\n We must collect the <\/span>right caste related data<\/span><\/b>. It should include measurements of the impact of reservations at the <\/span>caste <\/span><\/b>and <\/span>community level<\/span><\/b>, and not merely at a group level (i.e., OBC\/SC\/ST). It will help in understanding <\/span>socioeconomic <\/span><\/b>and <\/span>political backwardness<\/span><\/b> and the benefits that have accrued from reservations to a particular community.\u00a0<\/span>\u00a0<\/span><\/p>\n Many state governments are running a digitization programme for caste certificates. This data can be linked with Aadhaar. It can help track reservation benefits across all castes.<\/span>\u00a0<\/span><\/p>\n There is a need to estimate the population levels of each caste group.
