{"id":17925,"date":"2018-03-29T15:52:13","date_gmt":"2018-03-29T10:22:13","guid":{"rendered":"http:\/\/blog.forumias.com\/?p=17925"},"modified":"2018-03-29T15:52:13","modified_gmt":"2018-03-29T10:22:13","slug":"karnataka-government-implements-scs-seniority-list","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/karnataka-government-implements-scs-seniority-list\/","title":{"rendered":"Karnataka government implements SC&#8217;s Seniority list"},"content":{"rendered":"<p><strong><u>Context: <\/u><\/strong><\/p>\n<ul>\n<li>The Karnataka State government has asked its department to implement the seniority list as directed by the Supreme Court.<\/li>\n<\/ul>\n<p><strong><u>Background: <\/u><\/strong><\/p>\n<ul>\n<li><strong>2017:<\/strong> The Supreme Court has invalidated a provision under the \u2018Karnataka Determination of Seniority of the Government Servants Promoted on the Basis of Reservation (to the posts in the civil services of the State) Act\u2019, 2002.<\/li>\n<li>The provision granted reservation in promotion to Schedule tribe and Schedule caste employees.<\/li>\n<li><strong>2018:<\/strong> The Karnataka government has asked its departments to revise the promotion list of employees as per the orders of the Supreme Court.<\/li>\n<\/ul>\n<p><strong><u>Justification of Supreme Court\u2019s judgment: <\/u><\/strong><\/p>\n<p>The justification of Supreme Court\u2019s judgment is as follows:<\/p>\n<ul>\n<li>The Act was doing away with the \u2018catch-up\u2019 rule and provided consequential seniority to in-service ST\/Sc employees.<\/li>\n<\/ul>\n<p><a href=\"http:\/\/blog.forumias.com\/consequential-seniority\/\" target=\"_blank\" rel=\"noopener\">Know more about consequential seniority<\/a><\/p>\n<p><a href=\"http:\/\/blog.forumias.com\/catch-up-rule\/\" target=\"_blank\" rel=\"noopener\">Know more about catch-up rule<\/a><\/p>\n<ul>\n<li>Consequential seniority was to an extent violating Article 14 and Article 16 of the Indian constitution.<\/li>\n<li>According to Article 16(4A), exercise for determining \u2018inadequacy of representation\u2019, \u2018backwardness\u2019 and \u2018overall efficiency\u2019 is a must for the exercise of Article 16(4A).<\/li>\n<\/ul>\n<p><a href=\"http:\/\/blog.forumias.com\/article-14-and-article-16-in-the-constitution-of-india-1949\/\" target=\"_blank\" rel=\"noopener\">Know more about Article 14 and Article 16 in the Constitution of India 1949<\/a><\/p>\n<p><strong><u>Impact of the judgment: <\/u><\/strong><\/p>\n<p>The impact of the judgment will be as follows:<\/p>\n<ul>\n<li>At least about 50,000 will see changes in their designations, either with a promotion or a demotion.<\/li>\n<li>Thousands of general category employees will be promoted.<\/li>\n<li>Many of ST\/SC employees belonging to the Scheduled Castes and Scheduled Tribes will have to be demoted to accommodate the general category employees.<\/li>\n<li>This judgment will affect 65 departments on the government.<\/li>\n<li>Note: This judgment doesn\u2019t affect those who are retired or those who have taken financial benefits already.<\/li>\n<li>It may have a huge impact on election prospects.<\/li>\n<\/ul>\n<p><strong><u>Conclusion: <\/u><\/strong><\/p>\n<ul>\n<li>This move by the Supreme Court is thus a major shift in the bureaucracy.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Context: The Karnataka State government has asked its department to implement the seniority list as directed by the Supreme Court.
