{"id":17982,"date":"2018-03-30T14:30:06","date_gmt":"2018-03-30T09:00:06","guid":{"rendered":"http:\/\/blog.forumias.com\/?p=17982"},"modified":"2018-03-30T14:30:06","modified_gmt":"2018-03-30T09:00:06","slug":"legalization-of-gambling-a-dicey-affair","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/legalization-of-gambling-a-dicey-affair\/","title":{"rendered":"Legalization of gambling: a dicey affair"},"content":{"rendered":"<p><strong><u>Context:<\/u><\/strong><\/p>\n<ul>\n<li>The Law Commission has recently sought views from the public and stakeholders on whether or not gambling and betting is morally justified in the Indian circumstances.<\/li>\n<\/ul>\n<p><strong><u>Background:<\/u><\/strong><\/p>\n<p><strong>Gambling: <\/strong><\/p>\n<ul>\n<li>Gambling is referred to as card games where high stakes are involved.<\/li>\n<\/ul>\n<p><strong>Betting:<\/strong><\/p>\n<ul>\n<li>Betting is referred to as casino games and putting a bet on an event such as a match.<\/li>\n<\/ul>\n<p><strong>Note: <\/strong><\/p>\n<ul>\n<li>The subject of gambling and betting is under the State list (Seventh Schedule, List II).<\/li>\n<li>According to Central and State Act, gambling is prohibited in public or public gaming houses.<\/li>\n<li>But there is no prohibition on such activities in a private house.<\/li>\n<\/ul>\n<p><strong>Law Commission\u2019s enquiry:<\/strong><\/p>\n<p>In the context of legalizing betting and gambling, the Law Commission wants to generate opinion on:<\/p>\n<ul>\n<li>curbing illegal activities,<\/li>\n<li>substantial revenue and employment generation,<\/li>\n<li>morally connotation in the Indian circumstances,<\/li>\n<li>safeguard against bankruptcy, and<\/li>\n<li>foothold of foreign betting and gambling companies in the country.<\/li>\n<\/ul>\n<p><strong><u>Why gambling should be legalized?<\/u><\/strong><\/p>\n<p>Gambling should be legalized because:<\/p>\n<ul>\n<li>Concerns revolving around gambling are unfounded.<\/li>\n<li>It will help curtail an important source of black money that is used by criminal syndicates.<\/li>\n<li>It will bring massive revenue to the state exchequer, which can be used for various constructive social schemes.<\/li>\n<\/ul>\n<p><strong>For instance: <\/strong>According to a conservative estimate: government could earn 10,000 crores as tax revenue by legalizing sports betting.<\/p>\n<ul>\n<li>It will help in creating large-scale employment opportunities.<\/li>\n<\/ul>\n<p><strong>For instance:<\/strong> The regulated gambling industry in the U.S. employs over 2.5 lakh people.<\/p>\n<ul>\n<li>Complete ban of gambling may in fact increase underground illegal betting and gambling activities.<\/li>\n<\/ul>\n<p><strong><u>What are the hurdles and complexities in legalizing gambling? <\/u><\/strong><\/p>\n<p>The hurdles and complexities in legalizing gambling are as following:<\/p>\n<ul>\n<li>It invariably leads to moral and monetary bankruptcy.<\/li>\n<li>Online gaming cannot be curbed by merely amending the Information Technology Act.<\/li>\n<li>There is no guarantee that legalising betting will generate revenue as projected.<\/li>\n<\/ul>\n<p><strong>Note:<\/strong><\/p>\n<ul>\n<li>As the subject of gambling figures in the State List, the Constitution will have to amended first so that gambling can figure in the Concurrent List.<\/li>\n<\/ul>\n<p><strong><u>What are some of the government measures to control gambling? <\/u><\/strong><\/p>\n<p><strong>\u00a0Public Gambling Act\u00a0(1867):<\/strong><\/p>\n<ul>\n<li>The Act provided for punishment for public gambling and keeping of common gaming houses.<\/li>\n<\/ul>\n<p><strong>Bombay Prevention of Gambling Act (1887):<\/strong><\/p>\n<ul>\n<li>The act is provided to consolidate and amend the law for the prevention of gambling in Maharashtra.<\/li>\n<\/ul>\n<p><strong><u>Way ahead: <\/u><\/strong><\/p>\n<p>Before legalizing gambling and betting, the measures to be taken are:<\/p>\n<ul>\n<li>Necessary infrastructure such as police machinery, prosecutors, etc,<\/li>\n<li>A robust regulatory framework governing the gaming sector,<\/li>\n<li>Awareness campaigns to educate people about the perils of excessive gambling,<\/li>\n<li>Exclusion of minors, habitual gamblers and vulnerable sections from having access to gaming facilities,<\/li>\n<li>Limitation on the amounts based on a person\u2019s financial capabilities, and<\/li>\n<li>Relevant provisos will have to be made in the Information Technology Act if gambling is to be regulated.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Context: The Law Commission has recently sought views from the public and stakeholders on whether or not gambling and betting is morally justified in the Indian circumstances.
