The State government claims that these demolitions are in response to illegal encroachments.<\/p>\n<p>However, the fact that these arbitrary demolitions are being carried out against the alleged rioters of one particular community and in the immediate aftermath of the riots shows that their purpose seems to be to impose collective punishment.<\/p>\n<p>Such an act violates various domestic and several international legal provisions under Right to housing.<\/p>\n<h5>What are the various domestic and international obligations being violated?<\/h5>\n<p><strong>Right to housing<\/strong>: The right to housing is a fundamental right recognised under Article 21 of the Indian Constitution. Further, it is also a well-documented right under the international human rights law framework, which is binding on India.<\/p>\n<p><strong>For instance<\/strong>,<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>UDHR<\/strong><\/span><\/p>\n<p><strong>&#8211;<\/strong> <strong>Article 25 of the <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/forumias.com\/blog\/universal-declaration-of-human-rights\/\">Universal Declaration of Human Rights (UDHR)<\/a><\/span><\/strong> states that \u201c<em>everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care\u2026<\/em>\u201d.<\/p>\n<p><strong>&#8211; Article 12<\/strong> of UDHR <strong>prohibits arbitrary interference<\/strong> in an individual\u2019s right to property. It also stipulates that \u201ceveryone has the right to the protection of the law against such interference or attacks\u201d.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>International Covenant on Civil and Political Rights (ICCPR)<\/strong><\/span><\/p>\n<p>Article 17 further provides that everyone has the right to own property alone as well as in association with others and that no one shall be arbitrarily deprived of his property. Thus, arbitrary interference with an individual\u2019s property is a gross violation of the <span style=\"color: #0000ff;\"><strong><a style=\"color: #0000ff;\" href=\"https:\/\/forumias.com\/blog\/international-covenant-on-civil-and-political-rights-iccpr\/\">ICCPR<\/a><\/strong><\/span>.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>ICESCR<\/strong><\/span><\/p>\n<p><strong>&#8211;<\/strong> <strong>Article 11.1 of the International Covenant on Economic, Social and Cultural Rights (ICESCR)<\/strong> recognises \u201cthe right of everyone to an adequate standard of living for himself and his family, including adequate food, clothing and <i>housing<\/i>, and to the continuous improvement of living conditions\u201d. Under this article, <strong>countries are under an obligation<\/strong> to take \u201cappropriate steps\u201d to ensure the realisation of these rights.<\/p>\n<p>The rights recognised under ICESCR, according to <strong>Article 4<\/strong>, can be restricted by States only if the limitations are determined by law in a manner compatible with the nature of these rights and solely to promote society\u2019s general welfare.<\/p>\n<p>Thus, the bulldozing of the houses by the Madhya Pradesh government of the alleged rioters amounts to forced eviction and arbitrary interference with an individual\u2019s home, thus a breach of Article 11.1 of the ICESCR.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Domestic law<\/strong><\/span><\/p>\n<p>The international human rights law identified above has been judicially incorporated by the Supreme Court of India into the Indian legal system.<\/p>\n<p>The apex court in cases like <strong><i>Bachan Singh vs State of Punjab<\/i>, <\/strong><i><strong>Vishaka vs State of Rajasthan<\/strong>,<\/i> and in the <i><strong>Puttaswamy vs Union of India<\/strong> <\/i>has stated that the fundamental rights must be read and interpreted in a manner which would enhance their conformity with international human rights law.<\/p>\n<h5>How does UN Human Rights Office details Right to housing?<\/h5>\n<p>According to the UN Human Rights Office, an integral element of the right to adequate housing is \u2018<em><strong>protection against forced evictions\u2019.<\/strong> <\/em><\/p>\n<p><em>It defines \u2018forced evictions\u2019 as \u2018permanent or temporary removal against the will of individuals, families and\/or communities from the homes and\/or land which they occupy, without the provision of, and access to, appropriate forms of legal or other protection\u2019.<\/em><\/p>\n<p>The right to adequate housing also entails <strong>freedom from arbitrary interference<\/strong> with one\u2019s home, privacy, and family.<\/p>\n<h5>What is the way forward?<\/h5>\n<p>As the custodian of India\u2019s constitutional order, it is high time that the judiciary acted and imposed necessary checks on the unbridled exercise of power by the executive.
