{"id":180517,"date":"2022-04-21T20:52:57","date_gmt":"2022-04-21T15:22:57","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=180517"},"modified":"2022-04-21T20:52:57","modified_gmt":"2022-04-21T15:22:57","slug":"bulldozed-due-process-courts-must-step-in-and-stop-state-local-authorities-from-ignoring-basic-principles","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/bulldozed-due-process-courts-must-step-in-and-stop-state-local-authorities-from-ignoring-basic-principles\/","title":{"rendered":"Bulldozed due process: Courts must step in and stop state\/local authorities from ignoring basic principles"},"content":{"rendered":"\n<p><strong>Context<\/strong>: Bulldozers continued to raze alleged encroachments in Delhi\u2019s Jahangirpuri \u2013 scene of rioting on Saturday \u2013 yesterday, forcing Supreme Court to expeditiously communicate its stay order to North Municipal Corporation of Delhi.<\/p>\n<p>Constitutional courts located in national\/state capitals must respond fast enough to such localised cases of overreach.<\/p>\n<h5>Why state action in this case is unjustified?<\/h5>\n<p>Razing of homes and shops<strong> hurts entire families. <\/strong><\/p>\n<p><strong>Due process not followed<\/strong>: Even if there are family members who allegedly rioted or even if structures are illegal, there\u2019s due process \u2013 innocent until proven guilty and adequate notice, respectively \u2013 to be followed.<\/p>\n<p>Moreover, Delhi has <strong>many other illegal encroachments<\/strong>. So, singling out Jahangirpuri is not proper.<\/p>\n<p>In terms of legality, the MCD Act has clear provisions:<\/p>\n<p><strong>&#8211;<\/strong> Under <strong>Section 317<\/strong> the Commissioner is supposed to issue notice to remove projections (structures or fixtures) onto streets,<\/p>\n<p><strong>&#8211; Section 343<\/strong> allows demolition of buildings with a minimum notice period of 5-15 days.<\/p>\n<p><strong>&#8211;<\/strong> Only <strong>Section 322<\/strong> doesn\u2019t require issuing notice, because it involves removing temporary structures like stalls encroaching into public streets.
