News<\/span><\/b>: Recently, the Supreme Court found serious fault within the high courts. The High Courts have consistently failed to uphold <\/span>judicial discipline<\/span><\/b> while pronouncing orders.\u00a0<\/span>\u00a0<\/span><\/p>\n A Rajasthan high court<\/span><\/b> bench granted<\/span> bail<\/span><\/b> to an accused of raping his minor niece without specifying any reasons. Here, the HC ignored circumstances like the alleged rapist was a <\/span>history sheeter<\/span><\/b>. He was facing around 20 other criminal cases. <\/span>The SC witnessed a lot of gaps between the <\/span>operative order<\/span><\/b> and <\/span>reasoned judgment<\/span><\/b> given by the High Courts. <\/span><\/p>\n The <\/span>Allahabad HC bench<\/span><\/b>, a B<\/strong><\/span>ombay HC bench<\/span><\/b> and a <\/span>Delhi HC bench<\/span><\/b> ordered acquittal in murder case(s) and gave the reasoned judgment(s) later after five months, nine months and ten months respectively.\u00a0\u00a0<\/span>\u00a0<\/span><\/p>\n There has been poor quality of justice delivery<\/strong> at various levels.\u00a0<\/span> Meanwhile, collegiums are struggling to attract good candidates to HCs.<\/strong> This is due to power struggle with GoI and unrealistic service conditions like low retirement age of 62.<\/span>\u00a0<\/span><\/p>\n High courts are invested with the all-important function of superintendence of around 20,000 subordinate judicial officers. Therefore, they should set their standards at a higher level.<\/span>\u00a0<\/span><\/p>\n Judges carry the burden that <\/span>\u201cjustice is not only done; justice is also seen to be done\u201d<\/span><\/b>.<\/span>\u00a0<\/span><\/p>\n The courts should <\/span>promptly<\/span><\/b> give a <\/span>reasoned order. <\/span><\/b>It also helps <\/span>appellate courts <\/span><\/b>save judicial time and decide appeals faster.\u00a0<\/span>\u00a0<\/span><\/p>\n The prompt reasoned order reduces burden on the judiciary. For example, The Supreme Court ordered fresh hearing in a case in which the <\/span>Allahabad HCs<\/span><\/b> failed to give a prompt reasoned order.
