{"id":181690,"date":"2022-04-28T20:36:46","date_gmt":"2022-04-28T15:06:46","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=181690"},"modified":"2022-04-28T20:36:46","modified_gmt":"2022-04-28T15:06:46","slug":"preventing-harm-on-judicial-intervention-against-hate-speech","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/preventing-harm-on-judicial-intervention-against-hate-speech\/","title":{"rendered":"Preventing harm: On judicial intervention against hate speech"},"content":{"rendered":"\n<p><strong>Context<\/strong>: After the Supreme Court called for \u201ccorrective measures\u201d against the peddling of communal hate from supposedly religious platforms, the authorities in Uttarakhand have prevented the holding of a \u2018dharam sansad\u2019 in Roorkee by imposing prohibitory orders against such gatherings.<\/p>\n<p>Recently, many such cases have come to the forefront wherein <strong>inflammatory speeches against particular communities<\/strong> have been made from supposedly religious platforms.<\/p>\n<p>To prevent any damage to the social fabric of our country, judicial intervention is, thus, supremely important.<\/p>\n<h5>Why a strict action on such incidents is required?<\/h5>\n<p>Provocateurs making <span style=\"color: #0000ff;\"><strong><a style=\"color: #0000ff;\" href=\"https:\/\/forumias.com\/blog\/hate-speech-in-the-time-of-free-speech\/\">hate speeches<\/a> <\/strong><\/span>are trying to <strong>inculcate a collective sense of fear<\/strong> among the majority that their interests are not being protected by an allegedly minority-friendly Constitution.<\/p>\n<p>The possible damage to the social fabric is incalculable, as the <strong>language of hatred may seep into the public consciousness<\/strong> as an acceptable thought process.<\/p>\n<p>The result may be <strong>an atmosphere in which communal harmony and public tranquillity will be at perennial risk<\/strong>.<\/p>\n<h5><strong>Way forward<\/strong><\/h5>\n<p>Modern democracies make a <strong>clear distinction between freedom of expression and speech that tends to incite hatred<\/strong> against a public group or section of society.<\/p>\n<p>Keeping this in mind, the Supreme Court in cases relating to lynching and \u2018khap panchayats\u2019, has laid down guidelines on preventive, remedial and punitive measures.
