It suggested a <\/span><b><span data-contrast=\"none\">humane<\/span><\/b><span data-contrast=\"none\"> and <\/span><b><span data-contrast=\"none\">reformist<\/span><\/b><span data-contrast=\"none\"> framework in the <\/span><b><span data-contrast=\"none\">criminal matters<\/span><\/b><span data-contrast=\"none\">. However, the death penalty can be given but only in the <\/span><b><span data-contrast=\"none\">rarest of rare cases<\/span><\/b><span data-contrast=\"none\">, that too when \u201c<\/span><b><span data-contrast=\"none\">the alternate option is unquestionably foreclosed\u201d<\/span><\/b><span data-contrast=\"none\">. The SC has neither elaborated on the <\/span><b><span data-contrast=\"none\">mitigating factors<\/span><\/b><span data-contrast=\"none\"> which could be used to avert the death penalty, in concrete terms, nor explained the issues such as <\/span><b><span data-contrast=\"none\">burden of proof <\/span><\/b><span data-contrast=\"none\">and <\/span><b><span data-contrast=\"none\">standard of pro<\/span><\/b><span data-contrast=\"none\">of in detail.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:150,&quot;335559740&quot;:390}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The\u202f<\/span><b><span data-contrast=\"none\">Bachan Singh\u202f principles<\/span><\/b><span data-contrast=\"none\"> have not been followed by the judiciary in letter and spirit. <\/span><\/p>\n<p><span data-contrast=\"none\">&#8211; For example, In\u202f<\/span><b><span data-contrast=\"none\">Ravji vs State of Rajasthan\u202f(1995)<\/span><\/b><span data-contrast=\"none\">, the Supreme Court said that it is the nature of the crime and not the criminal which is important to decide the punishment<\/span><\/p>\n<p><span data-contrast=\"none\">&#8211; In\u202f<\/span><b><span data-contrast=\"none\">Machhi Singh vs State of Punjab\u202f(1983)<\/span><\/b><span data-contrast=\"none\">, the Court indicated that inadequacy of other punishments could justify the death penalty.
