The observations made were:<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:150,&quot;335559740&quot;:390}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(1) The objectives behind <\/span><b><span data-contrast=\"none\">the Constitution (Sixty-ninth Amendment) Act<\/span><\/b><span data-contrast=\"none\"> shall guide the interpretation of <\/span><b><span data-contrast=\"none\">Article 239AA<\/span><\/b><span data-contrast=\"none\">. Article 239AA was interpreted from the perspective of the principles of federalism and democracy, thereby, according <\/span><b><span data-contrast=\"none\">a sui generis status<\/span><\/b><span data-contrast=\"none\"> to Delhi in distinction from other Union Territories (UT) which were more centrally governed.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:150,&quot;335559740&quot;:390}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(3)\u00a0 The Delhi Assembly has the power to make laws over all subjects that figure in the Concurrent List, and all, except three excluded subjects, in the State List. Further, in these matters, the LG is bound by the \u201caid and advice\u201d of the Council of Ministers of Delhi.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:150,&quot;335559740&quot;:390}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(4) The L-G ought to act on the \u201c<\/span><b><span data-contrast=\"none\">aid and advice<\/span><\/b><span data-contrast=\"none\">\u201d of the Council of Ministers, except when he refers <\/span><b><span data-contrast=\"none\">\u201ca matter\u201d<\/span><\/b><span data-contrast=\"none\"> to the President for a final decision in case of a difference of opinion between L-G and the Council of Ministers. However, the SC ruled that \u201cany matter\u201d cannot be construed to mean \u201cevery matter\u201d.
