News:<\/span><\/b> Recently, the Union government revoked the orders and guidelines issued under the Disaster Management Act (DMA), 2005 after covid knocked on India\u2019s doors. The DMA has been the backbone of policy interventions to fight covid.\u00a0<\/span>\u00a0<\/span><\/p>\n Any legislation can be passed under an enabling <\/span>constitutional provision<\/span><\/b>. Article 246 talks about the Union, state and concurrent lists which are mentioned in <\/span>the Seventh Schedule of the Constitution.<\/span><\/b>\u00a0<\/span><\/p>\n Considering, <\/span>health<\/span><\/b> is a state subject mentioned in the <\/span>state list a<\/span><\/b>nd <\/span>disasters<\/span><\/b> do not find mention in any lists in <\/span>the Schedule VII<\/span><\/b>. Therefore, the union government invoked <\/span>the Disaster management Act (DMA) 2005<\/span><\/b> by relating to <\/span>Entry 23 (Social Security and Social Insurance)<\/span><\/b> in the Concurrent List of the Constitution. It was invoked to deal with covid-19.\u00a0<\/span>\u00a0<\/span><\/p>\n Some states like West Bengal, Maharashtra, Odisha, Jharkhand and Chhattisgarh legalized the <\/span>home delivery<\/span><\/b> of alcohol under the ambit of the DMA. Ironically, it was invoked for liquor delivery to promote <\/span>social security and social insurance<\/span><\/b>. It was also aimed to address a shortfall in tax revenues (Taxes on alcohol account for a significant share of the total revenue in many states)\u00a0<\/span>\u00a0<\/span><\/p>\n However, at present the DMA has been revoked. Therefore, in the <\/span>absence<\/span><\/b> of ena<\/span>bling legislation<\/span><\/b> (due to revocation of the DMA), the states will have to curtail the home delivery of alcohol.\u00a0<\/span>\u00a0<\/span><\/p>\n The Seventh Schedule was inherited from <\/span>the Government of India Act, 1935<\/span><\/b>. Therefore, it is a <\/span>relic<\/span><\/b> of the <\/span>colonial past<\/span><\/b>. The lists do not reflect the <\/span>complex realities<\/span><\/b> of India in its <\/span>75th year of independence<\/span><\/b>. For example, despite having health as the state subject, the Union government was in a better position to legislate on some issues related to health (vaccination, for instance)<\/span>\u00a0<\/span><\/p>\n The states often shift their <\/span>responsibilities<\/span><\/b> upon centre. For example: (1) state highways are often classified as national highways, and (2) the states ask for the help of paramilitary forces in times of crisis despite having law and order as the state subjects.<\/span>\u00a0<\/span><\/p>\n States have also advocated the <\/span>transfer<\/span><\/b> of some subjects from the <\/span>Union<\/span><\/b> and <\/span>concurrent lists<\/span><\/b> to the state list. For instance, <\/span>entry No. 58<\/span><\/b> of the Union list is on the manufacturing, supply and distribution of salt.\u00a0<\/span>\u00a0<\/span><\/p>\n States have also criticized the transfer of some subjects from the state list to the concurrent list. \u2018<\/span>\u00a0<\/span><\/p>\n The <\/span>Sarkaria Commission<\/span><\/b> and <\/span>the Punchi Commission<\/span><\/b>. Both advised comprehensive consultation between the Union and state governments before moving anything from the state list to the concurrent list.\u00a0<\/span>\u00a0<\/span><\/p>\n N.K.
