News<\/span><\/b>: Recently, the Chief Justice of India (CJI) proposed <\/span>a\u202fNational Judicial Infrastructure Corporation (NJIC)<\/span><\/b> with corresponding bodies at the State level at the joint conference of Chief Justices and Chief Ministers.<\/span>\u00a0<\/span><\/p>\n

Arguments in favour<\/span><\/b>\u00a0<\/span><\/h5>\n

The court complexes have a lot of inadequacies in India. There is a wide gulf between the <\/span>available infrastructure<\/span><\/b> and the <\/span>justice needs<\/span><\/b> of the people of India. The proposed NJIC would immensely help in augmenting facilities for the judiciary.<\/span>\u00a0<\/span><\/p>\n

There are already some agreements on the idea of s<\/strong><\/span>tate-level bodies<\/span><\/b> for the same purpose.<\/span>\u00a0<\/span><\/p>\n

Arguments against<\/span><\/b>\u00a0<\/span><\/h5>\n

There are experiences that <\/span>funds allocated<\/span><\/b> to many states for judicial infrastructure remain unspent. The proposal did not find favour with many Chief Ministers.<\/span>\u00a0<\/span><\/p>\n

There are apprehensions that a national body would usurp the powers of the executive. Therefore, the proposal did not find favour with many Chief Ministers.<\/span>\u00a0<\/span><\/p>\n

Measures that can be taken in the future<\/span><\/b>\u00a0<\/span><\/h5>\n

The Chief Justice of India proposed to have <\/span>adequate representation<\/span><\/b> of the Union\/States in the NJIC.<\/span>\u00a0<\/span><\/p>\n

The state level bodies proposal is to be implemented as a <\/span>centrally sponsored scheme<\/span><\/b> (CSS), with the Centre and States sharing the burden on a 60:40 ratio. The allocated funds for proposed <\/span>State-level bodies <\/span><\/b>should be actively spent for speeding up implementation of the scheme.<\/span>\u00a0<\/span><\/p>\n

It will naturally require greater <\/span>coordination<\/span><\/b> between States and the respective High Courts for creation of required infrastructure, especially for the lower judiciary.\u00a0<\/span>\u00a0<\/span><\/p>\n

The Government has to contribute a lot to <\/span>reduce the burden<\/span><\/b> of the judiciary. The Government should also focus on <\/span>other challenges<\/span><\/b>: pendency, chronic shortage of judges etc.\u00a0<\/span>\u00a0<\/span><\/p>\n

The government should implement court orders, leaving crucial questions to be decided by the courts.<\/span>\u00a0<\/span><\/p>\n

The government should ensure <\/span>broad-based consultation<\/span><\/b> before passing legislation. This would reduce the litigation burden on the part of the courts.\u00a0<\/span>\u00a0<\/span><\/p>\n

The judiciary and the executive at the level of Chief Justices and Chief Ministers should have a conversation. It will infuse an <\/span>atmosphere<\/span><\/b> of<\/span> cooperation<\/span><\/b> for the judicial appointments, infrastructure upgradation and downsizing pendency in Indian courts.<\/span>\u00a0<\/span><\/p>\n
