News<\/strong>: Recently, two tribal men were beaten to death in Seoni, Madhya Pradesh, on the suspicion that they were slaughtering cows.\u00a0<\/span>\u00a0<\/span><\/p>\n

Why mob lynching and aftermath incidents are disturbing?<\/span><\/b>\u00a0<\/span><\/h5>\n

These laws have led to a <\/span>stigmatisation of communities<\/span><\/b> such as Dalits, Muslims and tribals for their <\/span>dietary habits<\/span><\/b> and their <\/span>dependence<\/span><\/b> on <\/span>cattle products<\/span><\/b> for a livelihood. Therefore, the brunt of the mob violence has been borne by Muslims, Dalits and Tribal. For example,<\/span> Pehlu Khan murder<\/span><\/b> in April 2017 in Rajasthan.\u00a0<\/span>\u00a0<\/span><\/p>\n

The <\/span>priorities of the law enforcement agencies<\/span><\/b> are absurd. For example, the police department has stated that one of the dead men was involved in a \u201ccow slaughter\u201d in this case.\u00a0<\/span>\u00a0<\/span><\/p>\n

While implementing the cattle slaughter laws, the police fail to try and bring those involved in lynch mobs to justice.\u00a0<\/span>\u00a0<\/span><\/p>\n

The cattle slaughter laws seem to have been brought for <\/span>appeasement of majoritarian<\/span><\/b> impulses to garner political support instead of looking for <\/span>animal preservation<\/span><\/b>.<\/span>\u00a0<\/span><\/p>\n

Judicial pronouncement related to anti-cattle slaughter laws?<\/span><\/b>\u00a0<\/span><\/h5>\n

In 2005, the <\/span>Supreme Court<\/span><\/b> had justified the total ban on cattle slaughter. The court interpreted the Articles 48, 48A, and 51(A) of the <\/span>directive principles of state policy<\/span><\/b> in the Constitution, that seeks to <\/span>preserve breeds<\/span><\/b> used in agriculture and <\/span>animal husbandry<\/span><\/b>, besides promoting compassion to animals.\u00a0<\/span>\u00a0<\/span><\/p>\n

The 1958 judgment had limited the ban only to \u201c<\/span>useful\u201d cattle<\/span><\/b> which are still engaged in <\/span>agriculture<\/span><\/b> and <\/span>husbandry<\/span><\/b>. Thus, stringent laws on cow slaughter were enacted.\u00a0<\/span>\u00a0<\/span><\/p>\n

Way Forward<\/span><\/b>\u00a0<\/span><\/h5>\n

The police should actively take action against the persons having alleged involvement.\u00a0<\/span>\u00a0<\/span><\/p>\n

Four States (<\/span>Rajasthan, Jharkhand, West Bengal and Manipur<\/span><\/b>) have passed laws against lynching. These laws are under various stages of implementation with the Union government because lynching is not a crime under the <\/span>Indian Penal Code (IPC).\u00a0<\/span><\/b>\u00a0<\/span><\/p>\n

The society should return to the rule of law in which such murderous acts do not go unpunished.\u00a0<\/span>\u00a0<\/span><\/p>\n

it is time for a judicial rethink on legislation around cattle slaughter.<\/span>\u00a0<\/span><\/p>\n
