News<\/span><\/b>: In recent, the Delimitation Commission awards for redrawn map for Jammu and Kashmir\u2019s Assembly has been notified.\u00a0<\/span>\u00a0<\/span><\/p>\n

Background<\/span><\/b>\u00a0<\/span><\/p>\n

The State\u2019s Assembly had been dissolved. It was under President\u2019s rule. Thereafter, the State of J&K had been divided into <\/span>two Union Territories<\/span><\/b> under <\/span>the Jammu and Kashmir Reorganisation Act, 2019. <\/span><\/b>And fresh elections could be held under the J&K Reorganization Act 2019. Therefore, the delimitation of J&K assembly was very important for conducting fresh elections.<\/span>\u00a0<\/span><\/p>\n

Composition of the Commission<\/span><\/b>\u00a0<\/span><\/h5>\n

Apart from <\/span>Retired Justice<\/span><\/b> Ranjana Prakash Desai, <\/span>Chief Election Commissioner (CEC)<\/span><\/b> Sushil Chandra <\/span>and J&K State Election Commissioner<\/span><\/b> K.K. Sharma were ex-officio members of the commission.<\/span>\u00a0<\/span><\/p>\n

Criticism of the commission\u2019s award<\/span><\/b>\u00a0<\/span><\/h5>\n

A long list of objections was made against the commission\u2019s draft. But the final report does not summarise the objections nor address them point by point.<\/span>\u00a0<\/span><\/p>\n

The commission has not explained the methodology<\/strong> based on which it awarded more seats to Jammu province relative to its population than the Valley province having a relatively larger population base. For example, Jammu gained <\/span>6 Assembly Seats<\/span><\/b> against <\/span>1 seat <\/span><\/b>gained by the Valley Province.\u00a0<\/span>\u00a0<\/span><\/p>\n

–<\/strong> In fact, the majority of the <\/span>six new constituencies <\/span><\/b>that are acquired by Jammu are Hindu-majority. Further, one Jammu constituency has a population of just over 50,000 people whereas a Muslim-majority constituency having the same physical features have close to four times its population.<\/span>\u00a0<\/span><\/p>\n

It did not explain why <\/span>Jammu\u2019s Muslim-majority seats<\/span><\/b> now comprise less than a quarter of the province\u2019s total seats despite the fact the Muslims comprise over a third of the province\u2019s population.<\/span>\u00a0<\/span><\/p>\n

The commission\u2019s recommended the President to <\/span>nominate<\/span><\/b> Pandit migrant<\/span><\/b>s to 2 Assembly seats, along the lines of reservation for Anglo-Indians in Parliament. However, it is silent on the nomination for Pandits who live in the Valley and West Pakistani refugees who live in the J&K.<\/span>\u00a0<\/span><\/p>\n

What is good in the award?<\/span><\/b>\u00a0<\/span><\/h5>\n

The commission proposed to match the boundaries of Assembly and parliamentary constituencies<\/strong>. This will ensure that Assembly and parliamentary constituencies match local administrative and police boundaries.\u00a0<\/span>\u00a0<\/span><\/p>\n

What are the challenges to the commission\u2019s award?<\/span><\/b>\u00a0<\/span><\/h5>\n

Further, the Supreme Court of India is about to hear the <\/span>challenges<\/span><\/b> to the <\/span>reorganisation act 2019<\/span><\/b>. In continuation, if the Court decides the challenges are <\/span>valid<\/span><\/b>, then the delimitation exercise will be <\/span>nullified<\/span><\/b>.<\/span>\u00a0<\/span><\/p>\n

The redrawn constituencies may result in <\/span>greater polarisation<\/span><\/b> of the community and people living in J&K in the next election. It may lead to risk of greater communal violence.<\/span>\u00a0<\/span><\/p>\n

If the outcome of the J&K Assembly election results reflects a <\/span>sharp<\/span><\/b> divide<\/span><\/b> between <\/span>Jammu<\/span><\/b> and the <\/span>Valley<\/span><\/b>, then it will make it more difficult to put together a <\/span>coalition administration<\/span><\/b> in the J&K Assembly.\u00a0<\/span>\u00a0<\/span><\/p>\n

Way Forward<\/span><\/b>\u00a0<\/span><\/h5>\n

The Election Commission should not delay announcing<\/span> dates<\/span><\/b> for the <\/span>long overdue Assembly<\/span><\/b> election<\/span><\/b> in Jammu and Kashmir as the redrawn constituencies have been notified.<\/span>\u00a0<\/span><\/p>\n

In order to ensure the <\/span>peace process<\/span><\/b> in Jammu and Kashmir, there has to be a clean election, speedy restoration of statehood.\u00a0<\/span>\u00a0<\/span><\/p>\n

In fact, the commission itself proposed that the <\/span>report<\/span><\/b> be <\/span>placed<\/span><\/b> before <\/span>the legislative assembly. <\/span><\/b>Therefore, let the new Jammu and Kashmir assembly approve or query the delimitation report.<\/span>\u00a0<\/span><\/p>\n

The government must give <\/span>attention<\/span><\/b> to <\/span>fundamental freedoms<\/span><\/b> of over a thousand Kashmiris who are held up in prison under sedition charges. They have been denied bail or asked to furnish punitive sureties.\u00a0<\/span>\u00a0<\/span><\/p>\n
