{"id":184547,"date":"2022-05-14T20:51:53","date_gmt":"2022-05-14T15:21:53","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=184547"},"modified":"2022-05-14T20:54:54","modified_gmt":"2022-05-14T15:24:54","slug":"how-to-make-a-uniform-civil-code","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/how-to-make-a-uniform-civil-code\/","title":{"rendered":"How to make a Uniform Civil Code"},"content":{"rendered":"\n<p><strong>News<\/strong>: Recently, a number of state governments have proposed to frame a <strong>Uniform Civil Code<\/strong> for their states.<\/p>\n<h5><strong>Step taken towards UCC in India So Far<\/strong><\/h5>\n<p>Parliament enacted a <strong>civil marriage law in 1954<\/strong>, <strong>the Special Marriage Act<\/strong> and <strong>the Indian Succession Act<\/strong>. These enactments were made available to all citizens of India as a <strong>secular alternative<\/strong>. Thus, these acts together constitute a UCC of an optional nature for all Indians alike.<\/p>\n<p>In addition, the Parliament also enacted a new law called <strong>the Hindu Marriage Act<\/strong> in 1955 to regulate <strong>religious marriages <\/strong>among the Hindus, Buddhists, Jains, and Sikhs. Further, A Hindu Succession Act came into force next year for the properties of those covered by the<strong> Hindu Marriage Act 1955<\/strong>.<\/p>\n<p>The people of <strong>Goa, Daman,<\/strong> and <strong>Diu<\/strong> are governed by an archaic <strong>Portuguese Civil Code of 1867<\/strong>. A sizable section of citizens called <strong>Renoncants<\/strong> (Indians whose ancestors had during the French rule abandoned personal law) in <strong>Puducherry<\/strong> are governed by the <strong>218-year-old French Civil Code of 1804. <\/strong><\/p>\n<h5><strong>What are the issues in the central personal laws?<\/strong><\/h5>\n<p>The Special Marriage Act is <strong>patently discriminatory<\/strong> in certain matters. It mentions the <strong>prohibited degree of marriage<\/strong> between <strong>close relatives<\/strong> (like the Hindu Marriage Act). Further, the Act does not prohibit marriages between <strong>distant cousins<\/strong> (i.e., <strong>sapinda relationshi<\/strong>p). Thus, an act, allows a Hindu to marry a second cousin despite <strong>religious prohibition<\/strong>, but a Muslim is debarred to marry a first cousin despite <strong>religious permission<\/strong>.<\/p>\n<p>In fact, the Hindu Marriage Act relaxes the <strong>rule of prohibited degrees<\/strong> on the basis of custom but not under the Special Marriage Act.<\/p>\n<p>During the <strong>Emergency days<\/strong>, the <strong>Special Marriage (Amendment) Act<\/strong> allowed both parties\u2019 (if Hindu) properties to be governed by the Hindu Succession Act instead of the Indian Succession Act. This was a <strong>retrograde step<\/strong>.<\/p>\n<h5><strong>What are the issues in proposals for the state-level uniform civil code laws?<\/strong><\/h5>\n<p>A state-level UCC seems to be prima facie incompatible with Article 44 of the Constitution. The article advocates to secure a uniform civil code for the citizens <strong>throughout the territory of India<\/strong>. The proposal can overlook all-India characters.<\/p>\n<p>Under the Constitution, <strong>family<\/strong> and <strong>succession laws<\/strong> are in the <strong>concurrent jurisdiction<\/strong> of the Centre and states. Therefore, law applicable in the entire country can be enacted by Parliament alone.<\/p>\n<h5><strong>Argument in favour of the state proposals<\/strong><\/h5>\n<p>The <strong>anachronistic foreign laws<\/strong> are still applicable on Indian citizens in certain parts of the country. Therefore, such a code can be enacted at the state-level.<\/p>\n<p><strong>The Way Forward<\/strong><\/p>\n<p>There should be a <strong>single law of family rights<\/strong> and <strong>succession<\/strong> for the entire country. The law should be in compliance with the constitutional guarantees for equality before the law and equal protection of laws<\/p>\n<p>The parliament should amend the <strong>discriminatory provisions <\/strong>of the Special Marriage Act relating to prohibited degrees in marriage. In addition, the 1976 amendment restricting the applicability of the Indian Succession Act must be set aside.<\/p>\n<p>To start, the parliament can <strong>repeal<\/strong> and <strong>replace<\/strong> the<strong> archaic foreign civil code<\/strong> prevalent in Goa, Daman Diu, and Puducherry with the central marriage and succession laws.
