Write some issues associated with those rules.<\/p>\n<p><strong>Way forward:<\/strong>\u00a0Write some suggestions.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Interstate police arrest means when the police of one state arrest the accused or culprit in some other state. The Seventh Schedule of the Indian Constitution puts \u2018<strong>Police\u2019 in the State list<\/strong>. The police comes directly under<br \/>\nthe control of the state government and the jurisdiction<br \/>\nof the police is limited to the area inside its state&#8217;s boundary.<br \/>\nThe incidents of interstate arrests are nowadays increasing across whole India. There are following rules which govern interstate arrests:<\/p>\n<ul>\n<li><strong>Code of Criminal Procedure (CrPC):<\/strong> Section 48 and 79\u00a0deals with\u00a0inter-state arrests based on warrants issued by competent courts.<\/li>\n<li><strong>Constitutional Provisions:<\/strong> \u00a0<strong>Article 22(2) <\/strong>states that every person\u00a0who is arrested and detained in custody\u00a0shall be produced before the\u00a0nearest magistrate within a period of 24 hours of such arrest.<\/li>\n<li><strong>Judicial stand:<\/strong> In 2019, in<strong>Sandeep Kumar vs the State (Government of NCT of Delhi) &amp; Ors<\/strong><em>,<\/em>\u00a0the Delhi High Court issued certain\u00a0guidelines for inter-state arrests.\u00a0E.g. before visiting the other state, the\u00a0Police Officer must try to establish contact with the local Police Station. These guidelines make\u00a0an exception for <strong>\u201curgent cases\u201d,<\/strong>\u00a0in which the police of a state may not inform their counterparts in the other state of an impending arrest.<\/li>\n<\/ul>\n<p><strong>Issues:<\/strong><\/p>\n<ul>\n<li>The powers of the police to interstate arrests without a warrant have not been defined clearly.<\/li>\n<li>Despite having an established methodology, implementation of the rules\u00a0has remained toothless.<\/li>\n<\/ul>\n<p><strong>Way forward:<\/strong><\/p>\n<ul>\n<li>The inter-state arrest comes with a set of rules which must be obligated before pursuing the same.<\/li>\n<li>An absence of cooperation amongst state police makes the goal of attaining justice a far-fetched one.<\/li>\n<li>Increasing interaction can only be sought if proper legislation is devised for investigation and arrest.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Introduction:\u00a0Contextual Introduction.
