However, the Governor refused to take a decision on his release and transferred the petition to the President.\u00a0<\/span><span style=\"font-weight: 400;\">Against this delay in release, a petition was filed before the Supreme Court.<\/span><\/p>\n<p><b>What did the Supreme Court held?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The court held that the TN Council of Minister&#8217;s advice to pardon Perarivalan was binding on the Governor under <\/span><a href=\"https:\/\/forumias.com\/blog\/article-161-of-indian-constitution\/\"><span style=\"font-weight: 400;\">Article 161<\/span><\/a><span style=\"font-weight: 400;\"> (Governor\u2019s power of clemency) of the Constitution.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This means that the Governor prima facie had no authority to transfer the mercy plea to the President.<\/span><\/p>\n<h5><b>Why was this a case for the Governor and not the President?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Perarivalan was not a death-sentenced convict (Earlier, the apex court had commuted his death penalty to a life sentence for murder in 2014). <\/span><span style=\"font-weight: 400;\">Hence, the Governor had no business forwarding the pardon plea to the President after sitting on it for years together.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Had this been a death penalty, the case would have been different. <\/span>Hence, by invoking Article 142, the court o<span style=\"font-weight: 400;\">rdered the release of A.G. Perarivalan.<\/span><\/p>\n<h5><b>Why did the Supreme Court invoke Article 142?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Governor\u2019s delay to decide Perarivalan\u2019s pardon for more than two years has compelled the apex court to employ its constitutional powers under Article 142 to do justice to Perarivalan.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After all, the court said, a Governor\u2019s non-exercise of power under Article 161 of the Constitution was not immune from judicial review.<\/span><\/p>\n<h5><b>What was the Centre\u2019s argument on this issue?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Centre\u2019s argument was that the President exclusively and not the Governor had the power to grant pardon in a case under Section 302 (murder) of the Indian Penal Code.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But the court said that such a contention would render Article 161 a \u201cdead-letter\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This would rather create an extraordinary situation whereby pardons granted by Governors in murder cases for the past 70 years would be rendered invalid.<\/span><\/p>\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article <\/span><b>\u201cPerarivalan, Rajiv Gandhi case convict, released by Supreme Court citing extraordinary powers\u201d <\/b><span style=\"font-weight: 400;\">published in<\/span><b> The Hindu <\/b>on<b> 19th May 2022.<\/b><\/p>\n","protected":false},"excerpt":{"rendered":"<p>What is the News?
