However, the constitution has not stipulated a time period for the consideration of the mercy pleas.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The <\/span><b><span data-contrast=\"none\">Article 161<\/span><\/b><span data-contrast=\"none\"> allows the convicts to file mercy pleas to <\/span><b><span data-contrast=\"none\">the Governor<\/span><\/b><span data-contrast=\"none\">. The Madras HC has ruled that the governor cannot exercise the power of pardon without the advice of the council of ministers.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"none\">Section 433A <\/span><\/b><span data-contrast=\"none\">of <\/span><b><span data-contrast=\"none\">the Criminal Procedure Code (CPC)<\/span><\/b><span data-contrast=\"none\"> mentions that the prisoners cannot be released from prison unless they had served a <\/span><b><span data-contrast=\"none\">minimum sentence of 14 years<\/span><\/b><span data-contrast=\"none\"> in prison.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The court opined that a life sentence means imprisonment for the remainder of one\u2019s life. The convicts can apply for remission under Sec.432, CrPC. Perarivalan was given the death sentence by the Special Court and was confirmed by the SC in 1998.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The convict petitioned the <\/span><b><span data-contrast=\"none\">Tamil Nadu Governor<\/span><\/b><span data-contrast=\"none\"> for mercy under <strong>Article 161<\/strong>. The Governor had dismissed the petitions.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The Convicts also filed mercy plea to the President of India. However, <\/span><b><span data-contrast=\"none\">Pratibha Patil, The President of Indi<\/span><\/b><span data-contrast=\"none\">a rejected the mercy pleas of the convicts after a delay of 11 years<\/span><span data-ccp-props=\"{&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Later, when the convicts were about to be executed, the convicts moved the Madras HC challenging the execution of the death warrant. The president took 11years. The state cabinet also advised the governor to grant pardon. After inordinate delay, the convicts moved to the court. The court held that \u201c<\/span><b><span data-contrast=\"none\">the Governor cannot sit on the state\u2019s recommendation on the release of all seven life convicts in the Rajiv Gandhi assassination case for so long\u201d<\/span><\/b><span data-contrast=\"none\">. The court was informed that the governor was awaiting the final report of the CBI\u2019s Multi-Disciplinary Monitoring Agency (MDMA).\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:2,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:420}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Later, the <\/span><b><span data-contrast=\"none\">T N Assembly<\/span><\/b><span data-contrast=\"none\"> passed a resolution granting mercy to the seven accused in 2018. The governor did not take any action. The convict reached <\/span><b><span data-contrast=\"none\">the Supreme Court<\/span><\/b><span data-contrast=\"none\"> where the governor stated that the matter was to be dealt with by the President.
