Context<\/strong>: Forensic sciences have gained great cultural popularity<\/strong> over the past two decades with the onset of crime shows on
\ntelevision. For example, Series like Law and Order, Mare of Easttown, Shetland and Real Detective.<\/p>\n

What is forensic science? <\/strong><\/h5>\n

Forensic science is the application of scientific perspectives<\/strong> and techniques<\/strong> to the legal process<\/strong>, including investigations<\/strong> and courtroom protocol<\/strong>. In other words, \u201cIt is the use of scientific data and procedures specifically for the legal system.\u201d<\/p>\n

There is rigorous procedure involved, including controlled conditions, reliable data collection and the attempt to disprove hypotheses.\u201d<\/p>\n

Forensic science involves methodologies<\/strong> like the autopsy procedures, fingerprinting, testing and matching for poisons, blood spatter analysis, matching guns to bullets fired (ballistics), voice sample matches, handwriting assessments and DNA analysis.<\/p>\n

Forensic science laboratories (FSL) in India<\/strong><\/h5>\n

At the Central level<\/strong><\/p>\n

There are seven central forensic laboratories <\/strong>in India at Hyderabad, Kolkata, Chandigarh, New Delhi, Guwahati, Bhopal and Pune. The CBI controls the laboratory in Delhi and the Directorate of Forensic Science Services (DFSS)<\/strong> controls other six laboratories, barring Delhi.<\/p>\n

Their mission is to render high quality and credible forensic services to the justice delivery system<\/p>\n

A National Forensic Sciences University<\/strong> was established in Gandhinagar, Gujarat<\/strong> in 2020.<\/p>\n

At the State level<\/strong><\/p>\n

There are 32 state FSLs<\/strong> and about 529 mobile FSL units<\/strong>, of which Delhi has one state FSL<\/strong> and six mobile units<\/strong>.<\/p>\n

Others<\/strong><\/p>\n

There are many private forensic laboratories<\/strong> in the country and their quality and standards of integrity vary.\u00a0<\/strong><\/p>\n

What is the importance of forensic science?<\/strong><\/h5>\n

The investigation is done for the collection of proof pointing to innocence or guilt. It also involves the deployment of forensic science<\/strong>.<\/p>\n

The criminal cases are solved by police conducting investigations<\/strong> which are aided by forensic scienc<\/strong>e. The well-trained forensic staff<\/strong> working in good quality laboratories aid the criminal justice system<\/strong>.<\/p>\n

What are the issues?<\/strong><\/h5>\n

India has amongst the highest disparities<\/strong> in police-citizens<\/strong> and judge-citizens ratios<\/strong>.<\/p>\n

The DNA tests discovered in 1985 are used to identify individuals involved in alleged crimes. In 2017,<\/p>\n

The United Kingdom completes DNA testing on over 60,000 crimes<\/strong> annually. However, India completes such tests on less than 7,500 cases despite having over 13 times the population of the UK.<\/p>\n

India has an inadequate number of forensic science laboratories (FSL)<\/strong>. In addition, there is a lack<\/strong> of adequate qualified personnel<\/strong>. For example, the Supreme Court observed In Re: Speedy Trial of Undertrial Prisoners (2018)<\/strong> that 97 posts of scientific officers and 67 administrative posts are unfilled in the Central Forensic Science Laboratories. Further, in all states, there were over 50% vacancies in personnel at their facilities.<\/p>\n

The average pendency at each lab is huge.<\/p>\n

The Court recognised that the lack<\/strong> of personnel<\/strong> meant that often trials were delayed to non-receipt of FSL reports<\/strong>.<\/p>\n

In India, the FSL reports take an inordinate amount of time<\/strong> to be prepared. This prevents conduct of forensic analysis<\/strong> and the criminal justice system relies principally on witness statements.<\/p>\n

Way Forward<\/strong><\/h5>\n

The Court had asked the central government to address the issue of non-filling of the personnel in FSL.<\/p>\n

India needs more investment in the establishment of FSL laboratories, the training and appointment of personnel.<\/strong><\/p>\n

There is a requirement of reforms within our police to establish a trained<\/strong> and skilled detective<\/strong> cadre<\/strong> tasked with solving complex<\/strong> and heinous crimes<\/strong>.<\/p>\n

There is a desperate need for good quality training facilities<\/strong>, standards of accreditation<\/strong> and continuous education programm<\/strong>es for our forensic experts.<\/p>\n

As forensic science is ever-evolving, it is important to know which facets of the science are still credible and what methodologies must be discarded.<\/p>\n
