{"id":188963,"date":"2022-06-06T20:29:01","date_gmt":"2022-06-06T14:59:01","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=188963"},"modified":"2022-06-06T20:31:00","modified_gmt":"2022-06-06T15:01:00","slug":"the-ipef-holds-promise-but-there-are-perils-too","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/the-ipef-holds-promise-but-there-are-perils-too\/","title":{"rendered":"The IPEF holds promise but there are perils too"},"content":{"rendered":"\n<p><strong>News:<\/strong> Recently, the US President Joe Biden has established the Indo-Pacific Economic Framework for Prosperity (IPEF) which is said to be a new version of a \u201cpivot to Asia\u201d.<\/p>\n<h5><strong>Background<\/strong><\/h5>\n<p>The US President had first spoken about it in October 2021 during the East Asia Summit, in the presence of all IPEF signatories except Fiji.<\/p>\n<h5><strong>Objectives <\/strong><\/h5>\n<p>To bring together the US allies in <strong>the Indo-Pacific region<\/strong> and enhance <strong>economic cooperation<\/strong> on the lines of the former U.S. President Barack Obama\u2019s pet project called as the Trans-Pacific Partnership (TPP),<\/p>\n<p>The US can fulfil its <strong>twin ambitions,<\/strong> to provide <strong>economic leadership<\/strong> and to challenge <strong>China\u2019s hegemony<\/strong> in the region.<\/p>\n<h5><strong>Features<\/strong><\/h5>\n<p><strong>T<\/strong>he IPEF has been proposed as an <strong>elaborate framework<\/strong> of rules covering <strong>four pillar<\/strong>s: (1) fair and resilient trade, (2) supply chain resiliency, (3) clean energy decarbonisation, and (4) tax and anti-corruption.<\/p>\n<p>In the Fair and resilient trade pillar, the IPEF \u201caims to develop <strong>high-standard<\/strong>, <strong>worker-centred commitments<\/strong>\u201d covering labour rights, the environment and climate, the digital economy, agriculture etc.<\/p>\n<h5><strong>Significance<\/strong><\/h5>\n<p>The intellectual property rights (IPRs) have been excluded from the list, which used to be at the heart of the U.S.\u2019 economic engagements with its partner countries. The possible reason could have been it acting as constraining forces in the universal coverage of the COVID-19 vaccine<\/p>\n<p>It has been designed differently from the free trade ideal. It has been proposed as a \u201c<strong>fair and resilient trade\u201d,<\/strong> not like a <strong>traditional trade agreement<\/strong>. The primary objective is to ensure a high degree of <strong>regulatory coherence<\/strong> and <strong>market access<\/strong> between the member countries.<\/p>\n<h5><strong>What are the associated issues?<\/strong><\/h5>\n<p><strong>Overall<\/strong><\/p>\n<p>The representatives of the pharmaceutical, and electronics sectors could pitch for the inclusion of the IPRs in the IPEF negotiations.<\/p>\n<p>Enforcement of <strong>labour<\/strong> rights have often been rejected by the <strong>World Trade Organization (WTO) members<\/strong> in the trade deals on several occasions. They argue that \u201cinternationally recognized core labour standards\u201d of the <strong>International Labour Organization (ILO<\/strong>) should be used to deal with issues pertaining to labour rights. They had also rejected the use of <strong>labour standards<\/strong> for <strong>protectionist purposes<\/strong>.<\/p>\n<p>The <strong>environment<\/strong> and <strong>climate change<\/strong> have been duly included in the list of the IPEF. In this connection, the <strong>United Nations Framework Convention on Climate Change (UNFCCC)<\/strong> has cautioned that measures taken by the countries to combat climate change should not be used to discriminate or cause disguised restriction on international trade\u201d.<\/p>\n<p>The <strong>standards<\/strong> on <strong>cross-border data flows<\/strong>, <strong>data localisations<\/strong> and <strong>data portability<\/strong> has been included. This can have ramifications on the future of the <strong>digital economy<\/strong> because there are contrasting views on the control over data, which is the driver of the digital economy.<\/p>\n<p>Although the U.S. wants its <strong>manufacturing giants<\/strong> to shift their bases from China to the other countries in the <strong>Indo-Pacific<\/strong>. But ensuring the <strong>supply chain resilience<\/strong> from new destinations will also remain a challenge.<\/p>\n<p><strong>For India<\/strong><\/p>\n<p>On this issue of <strong>data localisation<\/strong>, based on the inputs from <strong>the Draft National E-Commerce Policy<\/strong>, the Government of India aspires for restrictions on cross-border data flows. This goes against \u201chigh-standard rules on cross-border data flows and data localization\u201d.<\/p>\n<p>India may also worry about rules on <strong>strengthening labour rights<\/strong> in the IPEF.
