Wade judgment<\/span><\/b><span data-contrast=\"none\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\"> Bodily autonomy and reproductive rights must be viewed from legal, medical, and social lenses.\u00a0 \u00a0<\/span><\/p>\n<h5>What are the challenges associated with MTP Act?<\/h5>\n<p><b><span data-contrast=\"none\">The <a href=\"https:\/\/forumias.com\/blog\/medical-termination-of-pregnancy-bill-2020-associated-issues\/\">Medical Termination of Pregnancy (Amendment) Act 202<\/a><\/span><\/b><span data-contrast=\"none\"><strong>1<\/strong>: The act is in reality far from ideal.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(1) It has been criticised for not taking a<\/span><b><span data-contrast=\"none\"> rights-based approach<\/span><\/b><span data-contrast=\"none\">. It doesn\u2019t give the pregnant person complete autonomy in ending the pregnancy. For example, a pregnancy can be terminated on <\/span><b><span data-contrast=\"none\">certain conditions<\/span><\/b><span data-contrast=\"none\"> which include:- (a) Grave danger to the physical\/mental health of the pregnant woman; (b) foetal abnormalities; (c) rape\/coercion; and (d) contraceptive failure.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(2) A woman\u2019s right to choose to end the pregnancy even in the first few weeks is still not recognised in India.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(3) Women have to undergo various systemic barriers. In fact, the final decision regarding termination of pregnancy is not decided by the pregnant person, but it is decided by <\/span><b><span data-contrast=\"none\">one\/two registered medical practitioners (RMP) <\/span><\/b><span data-contrast=\"none\">or a <\/span><b><span data-contrast=\"none\">medical board<\/span><\/b><span data-contrast=\"none\"> depending on the<\/span><b><span data-contrast=\"none\"> gestational period.<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(4) It uses the word \u201cwoman\u201d, thereby leaving out<\/span><b><span data-contrast=\"none\"> pregnant transgender<\/span><\/b><span data-contrast=\"none\"> and <\/span><b><span data-contrast=\"none\">non-binary persons <\/span><\/b><span data-contrast=\"none\">who are biologically capable of bearing children.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(5) Other significant issues are the lack of access to RMPs, affordability, and social stigma. These issues lead to <\/span><b><span data-contrast=\"none\">unsafe abortions<\/span><\/b><span data-contrast=\"none\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(6) Further, abortion facilities are not provided in <\/span><b><span data-contrast=\"none\">all public health centres,<\/span><\/b><span data-contrast=\"none\"> especially in rural India. And, abortion facilities in <\/span><b><span data-contrast=\"none\">private medical centres <\/span><\/b><span data-contrast=\"none\">are expensive. It is available only for those who have the <\/span><b><span data-contrast=\"none\">resources<\/span><\/b><span data-contrast=\"none\"> like those belonging to the high class and persons having caste privilege. Therefore, most unmarried women end up resorting to unsafe abortions in illegal clinics or at home.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(a) In India, the <\/span><b><span data-contrast=\"none\">skewed sex ratio <\/span><\/b><span data-contrast=\"none\">is proof that unsafe abortions and female foeticide are rampant.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(b)<\/span> <span data-contrast=\"none\">According to the NFHS 2019-21, 27% of the abortions were carried out by the woman herself at home.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(c) According to\u202fthe <\/span><b><span data-contrast=\"none\">UNs Population Fund (UNFPA) State of the World Population Report 2022,<\/span><\/b><span data-contrast=\"none\"> around 8 women die each day in India due to unsafe abortions. About 67% of the abortions were classified as unsafe between 2007-2011.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h5><b><span data-contrast=\"none\">About the Surrogacy (Regulation) Act 2021<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h5>\n<p><span data-contrast=\"none\">(1) The Act has been alleged to be <\/span><b><span data-contrast=\"none\">exclusionary <\/span><\/b><span data-contrast=\"none\">in nature, disregards privacy, and also exploits women\u2019s reproductive labour.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(2) The act has been alleged to be disregarding privacy. It requires the intending couple to declare their infertility and reveals the identity of the surrogate, both of which violate the right to privacy and<\/span><b><span data-contrast=\"none\"> the landmark Puttaswamy judgment<\/span><\/b><span data-contrast=\"none\">.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(3) It strips the <\/span><b><span data-contrast=\"none\">reproductive autonomy<\/span><\/b><span data-contrast=\"none\"> of LGBTQ+ persons and single, divorced, and widowed intending parents. Only <\/span><b><span data-contrast=\"none\">a heterosexual married couple<\/span><\/b><span data-contrast=\"none\"> (with certain preconditions) can be the intending parents. Therefore, It can also be seen as a violation to <\/span><b><span data-contrast=\"none\">the fundamental right to equality.<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(4) It allows only altruistic surrogacy, denying women compensation for their reproductive labour. It is also seen as a <\/span><b><span data-contrast=\"none\">direct manifestation <\/span><\/b><span data-contrast=\"none\">of the patriarchal mindset.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h5>What should be done?<\/h5>\n<p><span data-contrast=\"none\">Experts believe that there should be regulations instead of<\/span><b><span data-contrast=\"none\"> a complete ban<\/span><\/b><span data-contrast=\"none\"> on <\/span><b><span data-contrast=\"none\">commercial surrogacy<\/span><\/b><span data-contrast=\"none\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The situation in India is far from perfect.
