{"id":194586,"date":"2022-07-07T20:23:17","date_gmt":"2022-07-07T14:53:17","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=194586"},"modified":"2022-07-07T20:23:17","modified_gmt":"2022-07-07T14:53:17","slug":"explained-why-twitter-has-moved-court-against-govts-content-blocking-orders","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/explained-why-twitter-has-moved-court-against-govts-content-blocking-orders\/","title":{"rendered":"Explained: Why Twitter has moved court against govt\u2019s content-blocking orders"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article<\/span><b> \u201cExplained: Why Twitter has moved court against govt\u2019s content-blocking orders\u201d <\/b><span style=\"font-weight: 400;\">published in <\/span><b>Indian Express <\/b>on<b> 6th July 2022.<\/b><\/p>\n<h5><b>What is the News?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Twitter has initiated legal action against the Government of India\u2019s order to take down certain content posted on the Twitter platform issued under Section 69 (A) of the Information Technology Act,2000.<\/span><\/p>\n<p><b>What is Section 69(A) of the Information Technology Act,2000?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">It empowers the government to order an intermediary for blocking access to any information in the digital world.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The grounds for exercising the power are; threat to national security, public order, sovereignty and integrity of the country, <\/span><span style=\"font-weight: 400;\">defence of India, security of the state, friendly relations with foreign states or public order or for preventing incitement to the commission of any cognisable offence relating to above.<\/span><\/p>\n<p><b>Penal Provisions<\/b><span style=\"font-weight: 400;\">: The intermediary who fails to comply with the orders will be punished with imprisonment for a term which may extend to seven years and shall also be liable to a fine.<\/span><\/p>\n<h5><b>Who are Intermediaries?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">According to the definition under Section 2(w) of the IT Act, an intermediary includes telecom service providers, network service providers, internet service providers, web-hosting service providers, search engines, online payment sites, and online auction sites, online marketplaces, cyber cafes etc.<\/span><\/p>\n<h5><b>Blocking Orders<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">While Section 69A provides the government with the power to order an intermediary to block content, the procedure to do so is listed in the Information Technology (Procedure and Safeguards for Blocking of Access of Information by Public) Rules, 2009.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As per rules, any request made by the government is sent to a review committee, which then issues these directions.\u00a0<\/span><\/p>\n<p><b>Note:<\/b><span style=\"font-weight: 400;\"> Blocking orders issued under Section 69 (A) of the IT Act are typically confidential in nature.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cExplained: Why Twitter has moved court against govt\u2019s content-blocking orders\u201d published in Indian Express on 6th July 2022.
