Timelines envisaged in code must be adhered to\u201d <\/b><span style=\"font-weight: 400;\">published in<\/span><b> Indian Express <\/b>on<b> 23rd July 2022.<\/b><\/p>\n<h5><b>What is the News?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court in <\/span><span style=\"font-weight: 400;\">Vidarbha Industries Power Ltd <\/span><i><span style=\"font-weight: 400;\">vs<\/span><\/i><span style=\"font-weight: 400;\"> Axis Bank Ltd has held that<\/span><span style=\"font-weight: 400;\"> it is not mandatory for the <\/span><span style=\"font-weight: 400;\">National Company Law Tribunal(NCLT) <\/span><span style=\"font-weight: 400;\">to admit an application to initiate Corporate Insolvency Resolution Process(CIRP) even if a debt exists and the Corporate debtor is in default.<\/span><\/p>\n<h5><b>What has been the process to initiate Corporate Insolvency Resolution Process(CIRP) so far?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Till now, in order to initiate proceedings under the IBC, financial creditors had to provide proof of the corporate debtor\u2019s default.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Once the adjudicating authority, the National Company Law Tribunal, was convinced of the default, the application was admitted. This allowed for quick admission of cases.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the judgment in Vidarbha Industries Power Ltd. v. Axis Bank appears to have created ambiguity in this process.\u00a0<\/span><\/p>\n<h5><b>What has changed after this judgment?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court has held that NCLT has to consider the grounds made out by the corporate debtor against admission, on its own merits.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This creates space for applications by financial creditors to be rejected even if there is a default.\u00a0<\/span><\/p>\n<h5><b>What will be the impact of this judgment?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The success of the IBC was in its attempt to transform the credit culture in the country. The threat of losing control over the firms was meant to ensure that borrowers honour their obligations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are indications of this threat has become a credible deterrence.
