The schedule offence contains an array of breaches under 30 different statutes including the Arms Act, 1959 and the Immoral Traffic (Prevention) Act, 1956, etc.<\/p>\n<p><strong>Nikesh Tarachand Shah vs Union of India case<\/strong>: The court declared the classification of offences under the PMLA into two categories as unconstitutional. The Court found the classification between offences unreasonable and the conditions themselves too disproportionate.<\/p>\n<p>The Parliament deleted the classification. Later the court upheld it.<\/p>\n<h5>What are the basic precepts of justice violated by PMLA?<\/h5>\n<p>Some basic precepts of justice and fairness are inherent to India\u2019s criminal justice system. These precepts are, <strong>a)<\/strong> A\u00a0person is presumed innocent until proven guilty, <strong>b)<\/strong> A person detained on suspicion of having committed an offence would be entitled to bail pending trial, <strong>c)<\/strong> A criminal law ought not to be retroactive, <strong>d)<\/strong> A person accused of an offence must be informed of the charges made against him; and <strong>e)<\/strong> A suspect has a privilege against incriminating herself.<\/p>\n<p>But the PMLA violated all these precepts.<\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>Read more: <a href=\"https:\/\/forumias.com\/blog\/narrow-view-sc-verdict-on-pmla-fails-to-protect-personal-liberty-from-draconian-provisions\/\">Narrow view \u2013 SC verdict on PMLA fails to protect personal liberty from draconian provisions<\/a><\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h5>What are the concerns associated with the PMLA?<\/h5>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>Read here:\u00a0<a href=\"https:\/\/forumias.com\/blog\/supreme-court-examines-allegations-of-rampant-misuse-of-pmla\/\">Supreme Court examines allegations of rampant misuse of PMLA<\/a><\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>The other concerns are,<\/p>\n<p><strong> PMLA is not a penal statute<\/strong>: The offence under the PMLA is separately prosecutable, unless the proceeds of crime related to a \u201cscheduled offence\u201d no case can be made out under the statute. In other words, if a person is ultimately acquitted or discharged in a case concerning the predicate offence, the charge under the PMLA can no longer be maintained.<\/p>\n<p><strong>Violative of K.S.
