{"id":198359,"date":"2022-08-02T17:59:17","date_gmt":"2022-08-02T12:29:17","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=198359"},"modified":"2022-08-02T18:01:51","modified_gmt":"2022-08-02T12:31:51","slug":"wheres-that-law","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/wheres-that-law\/","title":{"rendered":"Where\u2019s that law?\u00a0"},"content":{"rendered":"\n<p><strong>Source<\/strong>: The post is based on the article <strong>\u201cWhere\u2019s That Law?\u201d <\/strong>Published in <b>The Times of India<\/b>\u00a0on 2<sup>nd<\/sup> August 2022.<\/p>\n<p><strong>Syllabus: <\/strong>GS 2 Important Provisions of the Constitution of India; Government Policies and Interventions for Development in various sectors and issues arising out of their Design and Implementation.<\/p>\n<p><strong>Relevance:<\/strong> Fundamental Right to Privacy<\/p>\n<p><strong>News:<\/strong> In May, The Unique Identification Authority of India (UIDAI) issued an advisory warning against sharing Aadhaar numbers with unauthorized entities.<\/p>\n<h5><strong>What are the issues related to privacy in India?<\/strong><\/h5>\n<p>Five years ago, the SC ruled the <strong>right to privacy<\/strong> as a <strong>fundamental right.<\/strong> However, there is <strong>a statutory vacuum<\/strong> in the laws related to privacy. India doesn\u2019t have <strong>a data protection law.<\/strong><\/p>\n<p>However, the <strong>Sri Krishna committee<\/strong> was constituted to make recommendations on the data protection law. Consequently, the GOI introduced <strong>the Personal Data Protection Bill<\/strong> 2019. But the government didn\u2019t conform to these recommendations and gave the government, sweeping exemptions from privacy norms. The government was endowed with powers to overrule the proposed <strong>Data Protection Authority<\/strong>, reducing it largely to an appendage rather than an independent regulator.<\/p>\n<p>Civil society was worried about these exemptions, as these give space to the government to undermine privacy.<\/p>\n<p>The <strong>joint committee<\/strong> <strong>of Parliament <\/strong>examining the Bill noted that it is difficult to distinguish between <strong>personal<\/strong> and <strong>non-personal data<\/strong>.<\/p>\n<p>There are incidents of theft of data from public and private agencies collecting biometric information like fingerprints. <strong>For example,<\/strong> people have lost money from bank accounts due to Aadhar.<\/p>\n<p>There are also threats like the <strong>Pegasus malware<\/strong> that infects mobile phones.<\/p>\n<p>There is opacity in the <strong>data collection operations <\/strong>of tech companies.<\/p>\n<h5><strong>What should be done?<\/strong><\/h5>\n<p>With the era of 5G and ever-<strong>greater sharing of data<\/strong> between smart devices, and coming big jumps in computing power, there is a dire need for the <strong>data protection law<\/strong> in India.<\/p>\n<p>Such a law is urgently needed to clarify the <strong>ownership, storage,<\/strong> and <strong>processing of personal data <\/strong>collected by public and private entities.<\/p>\n<p>The law will codify the responsibilities and liabilities of these entities.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cWhere\u2019s That Law?\u201d Published in The Times of India\u00a0on 2nd August 2022.
