{"id":198527,"date":"2022-08-03T18:16:29","date_gmt":"2022-08-03T12:46:29","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=198527"},"modified":"2022-08-03T18:16:29","modified_gmt":"2022-08-03T12:46:29","slug":"costs-of-delayed-justice","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/costs-of-delayed-justice\/","title":{"rendered":"Costs of delayed justice"},"content":{"rendered":"\n<p><strong>Source<\/strong>: The post is based on an article <strong>\u201cCosts of delayed justice\u201d<\/strong> published in the <strong>Business Standard<\/strong> on <strong>2<sup>nd<\/sup> August 2022<\/strong>.<\/p>\n<p><strong>Syllabus: <\/strong>GS 2, Functioning of the Indian Judiciary<\/p>\n<p><strong>Relevance: <\/strong>Issues and Challenges Pertaining to the Indian Judiciary<\/p>\n<p><strong>News: <\/strong>Recently, The Prime Minister of India spoke at the first all-India legal district services authorities meeting in Delhi.<\/p>\n<h5><strong>PM\u2019s Remarks about the issues in the Indian Judicial System<\/strong><\/h5>\n<p>He referred to the poor state of affairs of the <strong>under-trial prisoners <\/strong>languishing in Indian jails.<\/p>\n<p>He referred to the inhuman conditions of overcrowded Indian jails, an issue which was also raised by indebted businessman Vijay Mallya in a British court.<\/p>\n<h5><strong>Other issues <\/strong><\/h5>\n<p>Although, the Supreme Court had mandated the release of under-trial prisoners who had been incarcerated for 10 years without being convicted. But, most of the states have not made any significant progress in this direction.<\/p>\n<p>There is a <strong>severe shortage of judges<\/strong> in Indian courts. The vacancies range between 20 and 40% at the high court and subordinate court levels. This happens due to the slow pace of judicial appointments at all levels.<\/p>\n<p>The shortage of judges has led to<strong> delayed justice <\/strong>for millions of Indians. For example, about 47mn cases are pending across different levels of the system.<\/p>\n<p>As per the PRS Legislative, if no new cases were filed, at the current disposal rate <strong>it would take high courts and subordinate courts three years each to dispose of the cases<\/strong>.<\/p>\n<p>In addition, the legal aid provided by the state is of <strong>poor quality<\/strong>. It has distorted Indians\u2019 access to justice. For example, most prefer to hire private lawyers to fight cases.<\/p>\n<p>As per a 2016 study, the <strong>litigants<\/strong> <strong>attending the lower courts<\/strong> incur the loss of over Rs 1,300 per day in their wages and businesses.<\/p>\n<p>India\u2019s low ranking on the World Bank\u2019s Global Ease of Doing Business survey, refers to the failure of the Indian judicial system to enforce contracts.<\/p>\n<h5><strong>The Way Forward<\/strong><\/h5>\n<p>The Prime Minister has said that <strong>justice delivery <\/strong>is as critical as <strong>access to justice.<\/strong><\/p>\n<p>The PM argued for \u201c<strong>ease of justice\u201d<\/strong> alongside <strong>ease of doing business<\/strong> and <strong>ease of living<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on an article \u201cCosts of delayed justice\u201d published in the Business Standard on 2nd August 2022.
