{"id":199849,"date":"2022-08-12T18:44:32","date_gmt":"2022-08-12T13:14:32","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=199849"},"modified":"2022-08-12T18:45:56","modified_gmt":"2022-08-12T13:15:56","slug":"punishing-process","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/punishing-process\/","title":{"rendered":"Punishing Process"},"content":{"rendered":"\n<p><strong>Source<\/strong>: The post is based on an article \u201c<strong>Punishing Process\u201d<\/strong> published in <strong>The Times of India<\/strong> on 12<sup>th<\/sup> August 2022.<\/p>\n<p><strong>Syllabus<\/strong>: GS 2 Important Provisions of the Constitution of India<\/p>\n<p><strong>Relevance: <\/strong>Fundamental Rights<\/p>\n<p><strong>News<\/strong>: Recently, the Supreme Court (SC) granted permanent medical bail to <strong>Varavara Rao<\/strong> on technical grounds, i.e., medical condition, advanced age, adherence to bail conditions, and delay in framing charges.<\/p>\n<h5><strong>Observations Made by the SC in this case<\/strong><\/h5>\n<p>Stringent restrictions against bail in laws like Unlawful Activities Prevention Act (UAPA) don\u2019t hinder <strong>constitutional courts<\/strong> from protecting fundamental rights.<\/p>\n<h5><strong>What are the issues in the bail provisions of India<\/strong><\/h5>\n<p>At present, too many accused, who have not been proven guilty, are in jail.<\/p>\n<p>The laws like UAPA have defeated the <strong>principle of bail as the norm &amp; jail as an exception. B<\/strong>ecause UAPA requires judges to deny bail if police cases seem to be prima facie true. For example, <strong>the Bhima Koregaon case<\/strong>.<\/p>\n<p>Many accused die before bail. <strong>For example,<\/strong> Stan Swamy died in judicial custody, while waiting for the Bombay High Court to decide on his plea for bail on medical grounds.<\/p>\n<p>In many cases, even the framing of charges isn\u2019t over.<\/p>\n<p>Undertrials as a percentage of the prison population have been steadily increasing and are 76% at present.<\/p>\n<p>The stringent bail provisions of custody and associated long process delays are nothing but a form of punishment.<\/p>\n<h5><strong>The Way Forward<\/strong><\/h5>\n<p>For Justice UU Lalit, who heard Rao\u2019s plea, and will be the next CJI, the problem of undertrial prisoners must take top priority.<\/p>\n<p>The SC bench had proposed <strong>a comprehensive bail law<\/strong>. It has reiterated that courts must decide on <strong>bail applications<\/strong> within two weeks.
