In India <strong>Article 21<\/strong> guarantees the right to speedy justice as a fundamental right. The criminal laws in India were majorly enacted by the British East India Company, but a lot of amendments were made to the laws.<\/p>\n<p><strong>Important changes<\/strong> <strong>in the criminal laws:<\/strong><\/p>\n<ul>\n<li><strong>Indian Penal Code (IPC<\/strong>): amended in 1983 and 1986 to introduce sections 498A for cruelty by husband and his relatives, and Section 304B for the <strong>dowry<\/strong> related death.<\/li>\n<li><strong>Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act<\/strong><strong>, 1989:<\/strong> to prevent the offences of atrocities against the members of the SCs and STs.<\/li>\n<li><strong>Protection of Children from Sexual Offences Act, 2012<\/strong>: to protect children from offences of sexual assault, sexual harassment and pornography and provide for establishment of Special Courts.<\/li>\n<li>The\u00a0<strong>Information Technology Act<\/strong>, <strong>2000<\/strong>: It has been amended to give <strong>legal sanctity to electronic documents and signatures<\/strong> to facilitate online transactions and check cybercrime.<\/li>\n<li><strong>National Investigation Agency (NIA<\/strong>): Constituted in 2008 after 26\/11 terror attacks, to investigate and prosecute offences affecting national security.<\/li>\n<li><strong>Section 377 of the IPC:<\/strong> The Supreme Court granted relief to the LGBTQ+ community.<\/li>\n<li>The SC has ruled that the <strong>right to privacy is one of the fundamental rights<\/strong> under the Constitution of India.<\/li>\n<\/ul>\n<p><strong>Present challenges:<\/strong><\/p>\n<ul>\n<li>There are allegations of using brute force and a large <strong>trust<\/strong> <strong>deficit between the public and police<\/strong>.<\/li>\n<li>Despite \u2018<strong>Police\u2019 being a State subject<\/strong>, no State government has given due attention to police reforms so far.<\/li>\n<li>No State or UT has adopted\u00a0<strong>the Model Police Act<\/strong>drafted by Soli J. Sorabjee.<\/li>\n<li>The State\u2019s police acts continue to live with <strong>British time provisions<\/strong>, like the connection between the\u00a0<strong>magistrates<\/strong>and the police in the system.<\/li>\n<li>Introduction of the\u00a0<strong>police Commissionerate system<\/strong>in metropolitan areas (as per the provisions of the\u00a0<strong>Criminal Procedure Code<\/strong>) is always resisted<strong>.<\/strong><\/li>\n<\/ul>\n<p><strong>Way forward:<\/strong><\/p>\n<ul>\n<li>The trust deficit can be bridged by <strong>improving soft skills<\/strong> and ensuring investigation in an impartial manner.<\/li>\n<li>The <strong>use of technology<\/strong> and forensic techniques must be encouraged to enhance the quality of evidence.<\/li>\n<li><strong>Specialised wings<\/strong> need to be established to deal with newer types of crime.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Introduction:\u00a0Contextual introduction.
