Also, write some challenges in ensuring right t privacy.<strong>Conclusion<\/strong>: Write a way forward.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Puttaswamy case resulted into declaration of <strong>right to privacy as a fundamental right under Article 21<\/strong> of the Indian Constitution. The Bench also held that while the right to privacy is still not an \u201cabsolute right\u201d in and of itself, placing limitations in a manner similar to those placed on the right to free speech and expression.<\/p>\n<p><strong>Positive effects of recognition of the right to privacy:<\/strong><\/p>\n<ul>\n<li>This strengthens freedom of thoughts, expressions, beliefs etc.<\/li>\n<li>Provides for protection <strong>against the state\u2019s interference<\/strong> in the private matters including marriage, family &amp; sex.<\/li>\n<li>It helps in preventing the situation of surveillance by the state.<\/li>\n<li>It gives boost to the <strong>rights of the transgender &amp; LGBT<\/strong> as confirmed by scrapping of section 377 of IPC.<\/li>\n<li>The dignity &amp; integrity of a people\u2019s body, mind &amp; thoughts are protected through Right to privacy.<\/li>\n<li>One can make the <strong>state accountable<\/strong> &amp; seek justice in case of any infringement in the private zone &amp; in case of unnecessary surveillance without consent.<\/li>\n<li>This also challenges the <strong>validity of privacy policies of many companies<\/strong> and makes them transparent and accountable.<\/li>\n<\/ul>\n<p><strong>Prevalent Issues after the recognition of the right to privacy<\/strong>:<\/p>\n<ul>\n<li><strong>Data security breaches<\/strong> which result in the loss and theft of personal, sensitive data have not reduced in terms of measurable frequency or their impact. E.g. alleged use of the <strong>Pegasus spyware<\/strong> in India.<\/li>\n<li>Elaborate <strong>phishing attacks<\/strong> and <strong>financial scams<\/strong> aided by the attacker\u2019s access to personal information, as well as other harmful activities.<\/li>\n<li>The security and integrity of their <strong>electronic devices<\/strong> are concerned.<\/li>\n<li>The <strong>lack of protectionist legislative measures<\/strong> enables a surveillance state run by both the government and chronic capitalism. Especially during an emergency such as the Covid pandemic.<\/li>\n<li>There is <strong>no independent data protection regulator<\/strong>, data subjects have limited rights, and there is almost no history of judicial enforcement of data privacy rights.<\/li>\n<\/ul>\n<p><strong>Way forward:<\/strong><\/p>\n<ul>\n<li>A <strong>Data Protection Authority<\/strong> (DPA), as an independent regulatory body responsible for the enforcement and effective implementation of the law must be established.<\/li>\n<li>Sensitive personal data that like biometric should be prohibited for use without written consent.<\/li>\n<li>The Central Government shall establish an <strong>appellate tribunal<\/strong> to hear and dispose of any appeal against an order of breach of privacy.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Introduction:\u00a0Contextual introduction.
