{"id":203111,"date":"2022-09-01T20:56:24","date_gmt":"2022-09-01T15:26:24","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=203111"},"modified":"2022-09-02T08:59:33","modified_gmt":"2022-09-02T03:29:33","slug":"personal-data-protection-firms-need-to-do-more","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/personal-data-protection-firms-need-to-do-more\/","title":{"rendered":"Personal data protection: Firms need to do more"},"content":{"rendered":"\n<p><strong>Source<\/strong>: The post is based on an article\u00a0\u201c<strong>Personal data protection: Firms need to do more<\/strong>\u201d\u00a0published in\u00a0<strong>The Business Standard<\/strong>\u00a0on\u00a0<strong>1<sup>st<\/sup> September 2022<\/strong>.<\/p>\n<p><strong>Syllabus: GS Paper 2 \u2013 Fundamental Rights <\/strong><\/p>\n<p><strong>Relevance:\u00a0data protection and concerns associated with it<\/strong><\/p>\n<p><strong>Context: This article discusses the issues associated with data and the ways to tackle it.<\/strong><\/p>\n<p><strong>What is the current issue with personal data protection?<\/strong><\/p>\n<p><strong>Lack of legislation protecting personal data<\/strong> allows Indian organizations to collect data as they want, often needlessly.<\/p>\n<p>The data is often sold, or monetized in other ways, and is frequently held in insecure servers.<\/p>\n<p>It opens the door to <strong>widespread misuse of data and to cybercrime, potentially targeting every Indian<\/strong>.<\/p>\n<p>It is also a <strong>barrier to efforts to set up data centers<\/strong> for overseas clients.<\/p>\n<p>It is a serious problem and is only expected to increase in scale as more segments of the economy get digitized.<\/p>\n<p>However, one of the reasons why Indian firms may not be investing enough in this area is because of a lack of regulatory compulsion.<\/p>\n<p><strong>What provisions can be included in a data protection law?<\/strong><\/p>\n<p>It should <strong>lay down clear, broad definitions <\/strong>of what constitutes private data. Those definitions should be open to review and updates as technology develops.<\/p>\n<p>There must be norms that data will not be collected needlessly.<\/p>\n<p>The data that is collected should be a small detail clearly stating purposes, keeping the data-owner informed and seeking his or her permission at every stage.<\/p>\n<p>There should also be clear norms for the security of any data collected and stored with the collector and storage center should be held liable for breaches with huge penalties.<\/p>\n<p>Victims should be in a position to easily bring class-action civil suits seeking damages in such cases.<\/p>\n<p>Data-owners should also have the \u201cright to forget\u201d.<\/p>\n<p>Once the purpose of the data has been served, the data-owner should have the option to ask for deletion.<\/p>\n<p>There should be a transparent process for granting clearance to any agency to launch a data collection-cum-surveillance\u00a0exercise against an individual or organisation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on an article\u00a0\u201cPersonal data protection: Firms need to do more\u201d\u00a0published in\u00a0The Business Standard\u00a0on\u00a01st September 2022.
