{"id":211914,"date":"2022-10-27T19:32:56","date_gmt":"2022-10-27T14:02:56","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=211914"},"modified":"2022-10-27T19:32:56","modified_gmt":"2022-10-27T14:02:56","slug":"antitrust-cases-against-google-how-regulator-decided-fine","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/antitrust-cases-against-google-how-regulator-decided-fine\/","title":{"rendered":"Antitrust cases against Google, how regulator decided fine"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article<\/span><b> \u201cAntitrust cases against Google, how regulator decided fine\u201d <\/b><span style=\"font-weight: 400;\">published in<\/span><b> Indian Express <\/b>on<b> 27th October 2022<\/b><\/p>\n<h5><b>What is the News?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Competition Commission of India(CCI) has fined Google twice \u2014 for abusing its dominant position in the market with its Android mobile operating system(OS) and for anti-competitive policies in its in-app billing and payment processing.<\/span><\/p>\n<h5><b>Abuse of Dominant Position<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Competition Commission of India(CCI) is empowered under the Competition Act, 2002 to check whether companies, especially large tech companies are not eliminating healthy competition in the market and creating a monopoly.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Section 4 of the Competition Act prohibits abuse of the dominant position of an enterprise in the market.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cDominant position\u201d means a position of strength enjoyed by an enterprise in the \u201crelevant market\u201d in India, which enables it to operate independently of competitive forces prevailing in the relevant market; or affect its competitors or consumers or the relevant market in its favour.<\/span><\/p>\n<h5><b>How is the penalty decided by CCI?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Under Section 27 of the Competition Act, CCI has the power to impose such a penalty as it may deem fit which shall be not more than 10% of the average turnover for the last three preceding financial years upon each of such persons or enterprises which are parties to such agreements or abuse.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2014, the Supreme Court ruled that the penalty should be imposed not on the \u201ctotal\/ entire turnover of the offending company\u201d but on \u201crelevant turnover\u201d.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cAntitrust cases against Google, how regulator decided fine\u201d published in Indian Express on 27th October 2022 What is the News?
