{"id":211958,"date":"2022-10-27T19:18:30","date_gmt":"2022-10-27T13:48:30","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=211958"},"modified":"2022-10-27T19:18:30","modified_gmt":"2022-10-27T13:48:30","slug":"protecting-competition-on-cci-penalty-on-google","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/protecting-competition-on-cci-penalty-on-google\/","title":{"rendered":"Protecting competition \u2013 on CCI penalty on Google"},"content":{"rendered":"\n<p><strong>Source<\/strong>: The post is based on an article\u00a0\u201cProtecting competition\u201d\u00a0published in\u00a0<strong>Business Standard <\/strong>on\u00a0<strong>27<sup>th<\/sup> October 2022<\/strong>.<\/p>\n<p><strong>Syllabus: GS 2 \u2013 Governance<\/strong><\/p>\n<p><strong>Relevance:\u00a0<\/strong>fines imposed on Google by CCI<\/p>\n<p><strong>News<\/strong>: The Competition Commission of India (CCI) has imposed two fines within seven days on Google.<\/p>\n<h5><strong>What were the reasons behind imposing fine?<\/strong><\/h5>\n<p>Fines were imposed for two reasons \u2013 a) misusing its dominant position in multiple categories related to the Android ecosystem, b) misusing its dominant market position with respect to its Play Store policies.<\/p>\n<p><strong>Multiple Categories:<\/strong> As per CCI, Google misused its position in the multiple categories that include misuse of android operating system, android apps, monopoly market share in search, etc.<\/p>\n<p><strong>Play Store Policies:<\/strong> Google made it mandatory to use Google Play Billing System (GPBS) for paid apps and in-app purchases for app developers which is termed as unfair practices by CCI. The failure to comply with using GBPS would not permit app developers to list on Play Store.<\/p>\n<p>Further, as per CCI, Google discriminated in favor of YouTube by not requiring GPBS for it and it also integrated GPay to its Play Store that gave unfair advantage to its own UPI app.<\/p>\n<p>Moreover, Google entered Mobile Application Distribution Agreements (MADA) with mobile manufacturers to ensure Google\u2019s apps are pre-installed.<\/p>\n<p>It gave a competitive edge to Chrome browser and YouTube and helped google to secure its exclusive position in online search.<\/p>\n<p>These were the reasons for imposing fine on Google and CCI has also directed google to take certain steps.<\/p>\n<h5><strong>What are the directions issued by CCI to Google?<\/strong><\/h5>\n<p>It has <strong>stopped Google from forcing manufacturers to pre-install its applications<\/strong> and it has been prohibited to offer any monetary incentive or to enter into any arrangement for search exclusivity.<\/p>\n<p>CCI also <strong>directed google to allow app developers to use third-party billing\/payment<\/strong> processing services. This would ensure proper level playing field amongst the payment providers.<\/p>\n<p>Google has been <strong>asked to come up with transparent policy on the data collected<\/strong>, use of data and also potential and actual sharing of data with other entities.
